勞務公司在簽訂勞動合同后能否單方面解除?

(一)勞動合同訂立的形式要求

勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同是(shi)用(yong)人單位與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)確立勞(lao)(lao)(lao)動(dong)(dong)(dong)關系(xi),明確雙方權利和義務的協議。《勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同法(fa)》第一條即明確其立法(fa)目的為“完善勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同制度,明確勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同雙方當事人的權利和義務,保護勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)的合(he)(he)法(fa)權益,構建和發展和諧(xie)穩定(ding)的勞(lao)(lao)(lao)動(dong)(dong)(dong)關系(xi)”,用(yong)人單位與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)訂(ding)立書(shu)面勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同是(shi)實現立法(fa)目的的重要(yao)保障。換言之,現行法(fa)律規定(ding)排(pai)除(chu)了事實勞(lao)(lao)(lao)動(dong)(dong)(dong)關系(xi)存在(zai)的合(he)(he)法(fa)性,即勞(lao)(lao)(lao)動(dong)(dong)(dong)關系(xi)一經(jing)建立起來,就必須(xu)簽訂(ding)書(shu)面的勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同。但也有(you)例(li)外,在(zai)非全日制用(yong)工狀況下,雙方當事人可以僅訂(ding)立口頭協議而不采用(yong)書(shu)面勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同。

(二)勞動合同訂立的時間要求

根據《勞(lao)動(dong)(dong)(dong)合(he)同(tong)法(fa)》第(di)(di)十條(tiao)第(di)(di)二款和第(di)(di)三款的規(gui)定:“已建(jian)立(li)(li)勞(lao)動(dong)(dong)(dong)關系(xi),未(wei)同(tong)時訂(ding)立(li)(li)書(shu)面(mian)勞(lao)動(dong)(dong)(dong)合(he)同(tong)的,應當自用(yong)(yong)(yong)(yong)(yong)工之(zhi)(zhi)日(ri)(ri)起(qi)(qi)一(yi)個月(yue)內訂(ding)立(li)(li)書(shu)面(mian)勞(lao)動(dong)(dong)(dong)合(he)同(tong)。用(yong)(yong)(yong)(yong)(yong)人單(dan)(dan)位(wei)在用(yong)(yong)(yong)(yong)(yong)工之(zhi)(zhi)前訂(ding)立(li)(li)勞(lao)動(dong)(dong)(dong)合(he)同(tong)的,勞(lao)動(dong)(dong)(dong)關系(xi)自用(yong)(yong)(yong)(yong)(yong)工之(zhi)(zhi)日(ri)(ri)起(qi)(qi)建(jian)立(li)(li)”,也就是說,用(yong)(yong)(yong)(yong)(yong)人單(dan)(dan)位(wei)與勞(lao)動(dong)(dong)(dong)者(zhe)訂(ding)立(li)(li)書(shu)面(mian)勞(lao)動(dong)(dong)(dong)合(he)同(tong),可以在用(yong)(yong)(yong)(yong)(yong)工前訂(ding)立(li)(li)、用(yong)(yong)(yong)(yong)(yong)工之(zhi)(zhi)日(ri)(ri)訂(ding)立(li)(li)或者(zhe)用(yong)(yong)(yong)(yong)(yong)工之(zhi)(zhi)日(ri)(ri)起(qi)(qi)一(yi)個月(yue)內訂(ding)立(li)(li)。換言(yan)之(zhi)(zhi),用(yong)(yong)(yong)(yong)(yong)人單(dan)(dan)位(wei)最遲必須在用(yong)(yong)(yong)(yong)(yong)工之(zhi)(zhi)日(ri)(ri)起(qi)(qi)一(yi)個月(yue)內與勞(lao)動(dong)(dong)(dong)者(zhe)訂(ding)立(li)(li)書(shu)面(mian)勞(lao)動(dong)(dong)(dong)合(he)同(tong)。

對于續訂(ding)(ding)勞動合同,用人單位(wei)應當(dang)在原勞動合同期限屆滿次日起一個月內與(yu)勞動者辦(ban)理續訂(ding)(ding)勞動合同手續。

公司在簽訂勞動合同后能否單方面解除?

案(an)例點評:根(gen)據(ju)《勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)法》的(de)(de)(de)規定(ding),用(yong)人(ren)(ren)單位(wei)(wei)自(zi)用(yong)工(gong)(gong)之日(ri)(ri)起即與勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)建立(li)勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)關系,用(yong)人(ren)(ren)單位(wei)(wei)與勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)在(zai)用(yong)工(gong)(gong)前(qian)訂立(li)勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)的(de)(de)(de),勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)關系自(zi)用(yong)工(gong)(gong)之日(ri)(ri)起建立(li)。本(ben)案(an)中,勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)約定(ding)劉(liu)某(mou)應(ying)于2011年3月(yue)(yue)1日(ri)(ri)到職上班(ban),但在(zai)2011年1月(yue)(yue)20日(ri)(ri)公(gong)司(si)通(tong)(tong)知(zhi)(zhi)解(jie)除勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)時(shi),劉(liu)某(mou)并未(wei)上班(ban),也就(jiu)是(shi)(shi)說雙方尚未(wei)建立(li)勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)關系。而(er)且(qie)由(you)于公(gong)司(si)已經招(zhao)聘了張女士擔(dan)任(ren)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)畫設計部經理,已不(bu)再需要劉(liu)某(mou)。根(gen)據(ju)《勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)法》的(de)(de)(de)規定(ding),勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)訂立(li)時(shi)所依(yi)據(ju)的(de)(de)(de)客觀情況(kuang)發生重大變(bian)化,致使勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)無(wu)法履行,經用(yong)人(ren)(ren)單位(wei)(wei)與勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)協商,未(wei)能就(jiu)變(bian)更(geng)合(he)同(tong)內容達成協議(yi)的(de)(de)(de),“用(yong)人(ren)(ren)單位(wei)(wei)提(ti)前(qian)三(san)十日(ri)(ri)以書(shu)面形(xing)式通(tong)(tong)知(zhi)(zhi)勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)本(ben)人(ren)(ren)或者(zhe)額外支(zhi)付(fu)勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)一個月(yue)(yue)工(gong)(gong)資后,可以解(jie)除勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)”。值(zhi)得(de)注意的(de)(de)(de)是(shi)(shi):關于“提(ti)前(qian)三(san)十日(ri)(ri)以書(shu)面形(xing)式通(tong)(tong)知(zhi)(zhi)勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)本(ben)人(ren)(ren)或者(zhe)額外支(zhi)付(fu)勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)一個月(yue)(yue)工(gong)(gong)資”的(de)(de)(de)解(jie)除勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong)的(de)(de)(de)規定(ding),是(shi)(shi)由(you)用(yong)人(ren)(ren)單位(wei)(wei)選(xuan)擇性采用(yong)的(de)(de)(de),不(bu)是(shi)(shi)同(tong)時(shi)并用(yong)的(de)(de)(de)。因此,在(zai)雙方尚未(wei)建立(li)勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)關系之前(qian),廣告公(gong)司(si)采用(yong)提(ti)前(qian)三(san)十日(ri)(ri)向劉(liu)某(mou)發出通(tong)(tong)知(zhi)(zhi)書(shu)的(de)(de)(de)形(xing)式解(jie)除勞動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)同(tong),符(fu)合(he)法律規定(ding),不(bu)需要再向劉(liu)某(mou)支(zhi)付(fu)補(bu)償金。
