(一)勞動工資報酬的確定

工(gong)資,是指用人單位依據國家法律規(gui)定(ding)(ding)或者勞(lao)(lao)動合(he)同約定(ding)(ding),定(ding)(ding)期(qi)以(yi)貨幣形(xing)式直接支付(fu)給勞(lao)(lao)動者勞(lao)(lao)動報(bao)酬。根據《關于工(gong)資總額(e)組(zu)成的規(gui)定(ding)(ding)》的規(gui)定(ding)(ding),工(gong)資的主要形(xing)式有:計時(shi)工(gong)資、計件工(gong)資、獎金、津貼和補貼、加班加點工(gong)資和特殊情況下(xia)支付(fu)的工(gong)資。

實踐中(zhong),用(yong)人單位對于勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)工(gong)(gong)(gong)資(zi)(zi)(zi)、報(bao)酬的約(yue)(yue)定種類(lei)很(hen)多(duo),大多(duo)數(shu)(shu)企(qi)(qi)業(ye)(ye)會(hui)在勞(lao)(lao)動(dong)(dong)合(he)同中(zhong)明確約(yue)(yue)定工(gong)(gong)(gong)資(zi)(zi)(zi)數(shu)(shu)額,只有(you)少(shao)數(shu)(shu)企(qi)(qi)業(ye)(ye)會(hui)通過區(qu)分工(gong)(gong)(gong)資(zi)(zi)(zi)報(bao)酬結(jie)構來約(yue)(yue)定勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)的工(gong)(gong)(gong)資(zi)(zi)(zi)數(shu)(shu)額。由于建筑(zhu)施(shi)工(gong)(gong)(gong)行業(ye)(ye)存在勞(lao)(lao)動(dong)(dong)密(mi)集型的行業(ye)(ye)特點,絕大多(duo)數(shu)(shu)建筑(zhu)施(shi)工(gong)(gong)(gong)企(qi)(qi)業(ye)(ye)會(hui)采取第(di)一(yi)種方式約(yue)(yue)定勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)工(gong)(gong)(gong)資(zi)(zi)(zi)報(bao)酬,值(zhi)得(de)注意(yi)的是,相對于其(qi)他(ta)行業(ye)(ye),建筑(zhu)施(shi)工(gong)(gong)(gong)企(qi)(qi)業(ye)(ye)也同樣存在大量管理型勞(lao)(lao)動(dong)(dong)者(zhe)(zhe),因此,結(jie)合(he)建筑(zhu)施(shi)工(gong)(gong)(gong)企(qi)(qi)業(ye)(ye)的經營發展需(xu)要,建立(li)具有(you)激勵制(zhi)度的區(qu)分工(gong)(gong)(gong)資(zi)(zi)(zi)報(bao)酬結(jie)構制(zhi)度,會(hui)促(cu)進建筑(zhu)施(shi)工(gong)(gong)(gong)企(qi)(qi)業(ye)(ye)的不斷發展壯大。

(二)勞動工資報酬的支付

1.工(gong)資(zi)支(zhi)付的形(xing)式

工資應(ying)當以法(fa)定貨幣(bi)形式支(zhi)付給勞動者,不得以實物或有價證券替代(dai)貨幣(bi)支(zhi)付。

2.工資支付的周期和方式

工資(zi)(zi)(zi)應(ying)當(dang)至少每月支(zhi)(zhi)付(fu)一次,但是用人(ren)(ren)單(dan)位與勞動(dong)(dong)者(zhe)協(xie)商一致后,也可(ke)以(yi)(yi)小時、日、周(zhou)為(wei)支(zhi)(zhi)付(fu)工資(zi)(zi)(zi)的(de)周(zhou)期。用人(ren)(ren)單(dan)位應(ying)當(dang)足額(e)支(zhi)(zhi)付(fu)工資(zi)(zi)(zi),不(bu)(bu)得以(yi)(yi)“每月暫發(fa)放生活費,待年底(di)結算”為(wei)借口克扣或者(zhe)無故拖欠(qian)勞動(dong)(dong)者(zhe)的(de)工資(zi)(zi)(zi)。另外,工資(zi)(zi)(zi)應(ying)當(dang)直接支(zhi)(zhi)付(fu)給勞動(dong)(dong)者(zhe)本人(ren)(ren),勞動(dong)(dong)者(zhe)本人(ren)(ren)因故不(bu)(bu)能領取工資(zi)(zi)(zi)時,可(ke)由其(qi)親屬或委托他人(ren)(ren)代領,不(bu)(bu)要將工資(zi)(zi)(zi)發(fa)放給“包工頭”或者(zhe)其(qi)他不(bu)(bu)具備用工主(zhu)體資(zi)(zi)(zi)格的(de)其(qi)他組織和(he)個人(ren)(ren),以(yi)(yi)免引發(fa)拖欠(qian)工資(zi)(zi)(zi)的(de)法律糾紛(fen)。

3.工資支付時間

工資(zi)必須在(zai)用人單位與勞動(dong)(dong)(dong)者(zhe)約(yue)定的日期支(zhi)付。如(ru)遇節假日或(huo)休(xiu)息(xi)日,則應當(dang)提前在(zai)最近(jin)的工作日支(zhi)付。對完成(cheng)(cheng)一(yi)(yi)次(ci)性臨(lin)時勞動(dong)(dong)(dong)或(huo)某項具(ju)體(ti)工作的勞動(dong)(dong)(dong)者(zhe),用人單位應按(an)有關協議或(huo)合同規定在(zai)其完成(cheng)(cheng)勞動(dong)(dong)(dong)任(ren)務后立即支(zhi)付工資(zi);在(zai)雙(shuang)方勞動(dong)(dong)(dong)關系依法解(jie)(jie)除或(huo)終止勞動(dong)(dong)(dong)合同時,企業應在(zai)解(jie)(jie)除或(huo)終止勞動(dong)(dong)(dong)合同時一(yi)(yi)次(ci)付清勞動(dong)(dong)(dong)者(zhe)工資(zi)。
