根據《勞動合同法》的規定,用人單位與勞動者協商一致,可以訂立無固定期限勞動合同。有下列情形之一的,除勞動者提出訂立固定期限勞動合同外,勞務公司應當訂(ding)立無固定期限勞動(dong)合同:
(1)勞動者在該用人單位連(lian)續工作滿(man)十年的;
(2)用人單位(wei)初次(ci)實行勞動(dong)合(he)同制(zhi)度(du)或者國有企業(ye)改制(zhi)重新(xin)訂立勞動(dong)合(he)同時,勞動(dong)者在(zai)該用人單位(wei)連續工作滿(man)十(shi)年且(qie)距(ju)法定退休年齡不(bu)足十(shi)年的(de);
(3)連續訂(ding)立兩次(ci)固(gu)定期限勞動合同(tong),且勞動者沒有《勞動合同(tong)法》第(di)三十九條和第(di)四十條第(di)一(yi)項(xiang)、第(di)二項(xiang)規定的情形(xing),續訂(ding)勞動合同(tong)的。
[案(an)例一(yi)]勞動(dong)者在同一(yi)個用人(ren)(ren)單位連續兩次訂(ding)立固定期限勞動(dong)合同后(hou),用人(ren)(ren)單位是(shi)否(fou)具有終(zhong)止或續訂(ding)勞動(dong)合同的(de)選擇權?
付(fu)(fu)某(mou)(mou)于2008年(nian)11月(yue)25日(ri)(ri)到某(mou)(mou)工(gong)(gong)程(cheng)監(jian)理(li)(li)公司工(gong)(gong)作(zuo),擔任監(jian)理(li)(li)工(gong)(gong)程(cheng)師。2008年(nian)12月(yue)23日(ri)(ri),雙(shuang)方簽訂(ding)了一年(nian)期勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong),合(he)(he)(he)同(tong)(tong)期限為2008年(nian)11月(yue)25日(ri)(ri)至(zhi)2009年(nian)11月(yue)24日(ri)(ri),勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)期滿后(hou),雙(shuang)方又續訂(ding)了一年(nian)期勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong),合(he)(he)(he)同(tong)(tong)終(zhong)止時間(jian)為2010年(nian)11月(yue)24日(ri)(ri),在2010年(nian)10月(yue)24日(ri)(ri),監(jian)理(li)(li)公司單方面向付(fu)(fu)某(mou)(mou)作(zuo)出《終(zhong)止勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)通知(zhi)書(shu)》,書(shu)面告知(zhi)與付(fu)(fu)某(mou)(mou)簽訂(ding)的勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)于2010年(nian)11月(yue)24日(ri)(ri)期限屆滿后(hou)終(zhong)止勞(lao)動(dong)(dong)(dong)(dong)關系。付(fu)(fu)某(mou)(mou)拒(ju)絕簽署《終(zhong)止勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)通知(zhi)書(shu)》,并要(yao)求簽訂(ding)無固定期限勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)。因(yin)公司不同(tong)(tong)意(yi)付(fu)(fu)某(mou)(mou)的要(yao)求,并于2010年(nian)11月(yue)25日(ri)(ri)停止了付(fu)(fu)某(mou)(mou)的工(gong)(gong)作(zuo),為此,付(fu)(fu)某(mou)(mou)申請勞(lao)動(dong)(dong)(dong)(dong)仲載。
案例點評:本案爭(zheng)議的(de)(de)焦(jiao)點是(shi)2008年之后,付某在同(tong)(tong)一(yi)個用(yong)人單位連續(xu)訂(ding)立了兩(liang)次(ci)固(gu)定(ding)(ding)期限(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong),用(yong)人單位是(shi)否具(ju)有終止或續(xu)訂(ding)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)的(de)(de)選(xuan)(xuan)擇權(quan)?最終仲裁庭裁決(jue)(jue)監理公司終止勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)行(xing)為違(wei)法(fa)(fa)(fa),并向付某支付違(wei)法(fa)(fa)(fa)解除勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)賠償(chang)金。筆者認為,根據《勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)法(fa)(fa)(fa)》第十(shi)(shi)四(si)條的(de)(de)規定(ding)(ding),用(yong)人單位在與勞(lao)(lao)(lao)(lao)動(dong)(dong)者連續(xu)兩(liang)次(ci)訂(ding)立勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong),且勞(lao)(lao)(lao)(lao)動(dong)(dong)者沒(mei)有《勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)法(fa)(fa)(fa)》第三十(shi)(shi)九條和第四(si)十(shi)(shi)條第一(yi)項、第二(er)項規定(ding)(ding)的(de)(de)情形的(de)(de),用(yong)人單位就喪失了與勞(lao)(lao)(lao)(lao)動(dong)(dong)者終止勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)的(de)(de)決(jue)(jue)定(ding)(ding)權(quan)。換言(yan)(yan)之,第二(er)次(ci)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)到期后,決(jue)(jue)定(ding)(ding)是(shi)否續(xu)訂(ding)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)的(de)(de)選(xuan)(xuan)擇權(quan)完全取決(jue)(jue)于(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)者。因此,對(dui)于(yu)用(yong)人單位而(er)言(yan)(yan),對(dui)于(yu)固(gu)定(ding)(ding)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)的(de)(de)期限(xian)的(de)(de)設置(zhi),必須(xu)慎(shen)之又(you)慎(shen),盡量避免短期化(hua)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)(tong)。
[案例二]員(yuan)工辭職后又重新在(zai)原單位入職,工期能否(fou)連續計算(suan)?
張(zhang)(zhang)(zhang)某(mou)(mou)于(yu)(yu)2000年5月份(fen)入職(zhi)某(mou)(mou)建筑工程公(gong)(gong)(gong)司(si)擔(dan)任工程師職(zhi)務,雙(shuang)(shuang)方簽訂(ding)了(le)固期(qi)(qi)限定為5年的(de)勞(lao)(lao)動(dong)合(he)同。2005年4月份(fen),張(zhang)(zhang)(zhang)某(mou)(mou)母親(qin)(qin)病(bing)重(zhong)住院,為了(le)照顧重(zhong)病(bing)母親(qin)(qin),張(zhang)(zhang)(zhang)某(mou)(mou)向公(gong)(gong)(gong)司(si)提出(chu)辭(ci)職(zhi),公(gong)(gong)(gong)司(si)予以批準。張(zhang)(zhang)(zhang)某(mou)(mou)辦理(li)完辭(ci)職(zhi)交(jiao)接工作后回到(dao)老家,其母親(qin)(qin)住院3個月后病(bing)逝。辦理(li)完喪事后,張(zhang)(zhang)(zhang)某(mou)(mou)向公(gong)(gong)(gong)司(si)提出(chu)希望再回公(gong)(gong)(gong)司(si)上班。基于(yu)(yu)張(zhang)(zhang)(zhang)某(mou)(mou)的(de)個人工作能(neng)力較強,公(gong)(gong)(gong)司(si)決定再次聘用張(zhang)(zhang)(zhang)某(mou)(mou),雙(shuang)(shuang)方于(yu)(yu)2005年10月份(fen)簽訂(ding)了(le)固定期(qi)(qi)限為5年的(de)勞(lao)(lao)動(dong)合(he)同。2010年10月份(fen)合(he)同到(dao)期(qi)(qi)時(shi),張(zhang)(zhang)(zhang)某(mou)(mou)向公(gong)(gong)(gong)司(si)提出(chu)訂(ding)立(li)無(wu)固定期(qi)(qi)限勞(lao)(lao)動(dong)合(he)同,公(gong)(gong)(gong)司(si)沒(mei)有(you)批準。張(zhang)(zhang)(zhang)某(mou)(mou)認(ren)(ren)為其在公(gong)(gong)(gong)司(si)工作時(shi)間(jian)(jian)已經(jing)滿十年,有(you)權要求(qiu)簽訂(ding)無(wu)固定期(qi)(qi)限勞(lao)(lao)動(dong)合(he)同,公(gong)(gong)(gong)司(si)則認(ren)(ren)為張(zhang)(zhang)(zhang)某(mou)(mou)連續工作時(shi)間(jian)(jian)未滿十年,公(gong)(gong)(gong)司(si)有(you)權決定是否簽訂(ding)無(wu)固定期(qi)(qi)限勞(lao)(lao)動(dong)合(he)同。雙(shuang)(shuang)方為此(ci)發生爭議。
案(an)例點(dian)評:根據《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)法》等(deng)相關法律(lv)規定(ding)(ding),只要(yao)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)在(zai)該用(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)連續工(gong)(gong)(gong)作(zuo)(zuo)滿(man)(man)十(shi)年(nian)的(de),就有權要(yao)求(qiu)訂立(li)無(wu)固定(ding)(ding)期限勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)。本案(an)件的(de)爭議焦(jiao)點(dian)問(wen)題(ti)是(shi),張某(mou)(mou)在(zai)某(mou)(mou)建(jian)筑工(gong)(gong)(gong)程公(gong)司(si)(si)連續工(gong)(gong)(gong)作(zuo)(zuo)時間(jian)是(shi)否(fou)已(yi)經(jing)滿(man)(man)十(shi)年(nian)。《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)部關于貫徹執行〈勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)法〉若干問(wen)題(ti)的(de)意見(jian)》第(di)22條規定(ding)(ding):“連續工(gong)(gong)(gong)作(zuo)(zuo)滿(man)(man)十(shi)年(nian)”是(shi)指勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)與(yu)同(tong)(tong)一(yi)用(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)簽訂的(de)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)期限不(bu)間(jian)斷達到十(shi)年(nian)。這(zhe)里關鍵(jian)把握兩(liang)點(dian):一(yi)是(shi)在(zai)“同(tong)(tong)一(yi)用(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)”,二(er)是(shi)“不(bu)間(jian)斷”。本案(an)中,張某(mou)(mou)在(zai)2005年(nian)4月(yue)份(fen)已(yi)與(yu)公(gong)司(si)(si)解除了勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong),雖(sui)在(zai)2005年(nian)10月(yue)再(zai)次入職(zhi)該公(gong)司(si)(si),但(dan)其工(gong)(gong)(gong)作(zuo)(zuo)時間(jian)已(yi)經(jing)間(jian)斷了6個月(yue),不(bu)符合(he)(he)“連續工(gong)(gong)(gong)作(zuo)(zuo)滿(man)(man)十(shi)年(nian)”的(de)條件。因此(ci)(ci),該公(gong)司(si)(si)不(bu)同(tong)(tong)意簽訂無(wu)固定(ding)(ding)期限勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)并不(bu)違反法律(lv)規定(ding)(ding)。但(dan)應當注意的(de)是(shi),有一(yi)些用(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)為了規避簽訂無(wu)固定(ding)(ding)期限勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong),采用(yong)(yong)(yong)不(bu)正當的(de)手段(duan)要(yao)求(qiu)員工(gong)(gong)(gong)“主動(dong)(dong)(dong)(dong)(dong)辭職(zhi)”或離職(zhi),間(jian)隔一(yi)段(duan)時間(jian)后再(zai)人(ren)職(zhi);或者(zhe)(zhe)在(zai)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)到期后,讓員工(gong)(gong)(gong)與(yu)其他關聯公(gong)司(si)(si)簽訂勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong),再(zai)以“派遣”方式繼續使(shi)用(yong)(yong)(yong)員工(gong)(gong)(gong),以此(ci)(ci)達到使(shi)員工(gong)(gong)(gong)的(de)工(gong)(gong)(gong)作(zuo)(zuo)年(nian)限“中斷”的(de)目的(de)。這(zhe)種惡意規避法律(lv)強制性規定(ding)(ding)的(de)行為,應當認定(ding)(ding)為合(he)(he)同(tong)(tong)無(wu)效。
以完成一定工作任務為期限的勞(lao)動(dong)合(he)同(tong),是指(zhi)用(yong)人單位與勞(lao)動(dong)者(zhe)之間約定以某(mou)項工作的完成作為終止時間的勞(lao)動(dong)合(he)同(tong)。
訂立以完(wan)成(cheng)(cheng)(cheng)一定(ding)(ding)工(gong)作(zuo)(zuo)任務(wu)為(wei)期限(xian)(xian)的(de)(de)勞(lao)動(dong)(dong)合同,用人(ren)單位(wei)與勞(lao)動(dong)(dong)者務(wu)必將(jiang)工(gong)作(zuo)(zuo)任務(wu)作(zuo)(zuo)明確的(de)(de)約定(ding)(ding),并且能(neng)夠清楚界(jie)定(ding)(ding)工(gong)作(zuo)(zuo)任務(wu)完(wan)成(cheng)(cheng)(cheng)的(de)(de)時(shi)間。以完(wan)成(cheng)(cheng)(cheng)一定(ding)(ding)工(gong)作(zuo)(zuo)任務(wu)為(wei)期限(xian)(xian)的(de)(de)勞(lao)動(dong)(dong)合同主要存在于建設工(gong)程施工(gong)項目(mu)、因(yin)季節原因(yin)臨時(shi)用工(gong)等工(gong)作(zuo)(zuo)項目(mu)中。根據(ju)《勞(lao)動(dong)(dong)合同法實施條(tiao)(tiao)例》的(de)(de)規(gui)定(ding)(ding),以完(wan)成(cheng)(cheng)(cheng)一定(ding)(ding)工(gong)作(zuo)(zuo)任務(wu)為(wei)期限(xian)(xian)的(de)(de)勞(lao)動(dong)(dong)合同因(yin)任務(wu)完(wan)成(cheng)(cheng)(cheng)而終止的(de)(de),用人(ren)單位(wei)應當依據(ju)《勞(lao)動(dong)(dong)合同法》第四十七條(tiao)(tiao)的(de)(de)規(gui)定(ding)(ding),向勞(lao)動(dong)(dong)者支(zhi)付(fu)經濟補(bu)償(chang)金。
