在(zai)科學發展觀指(zhi)導下,加快完(wan)善(shan)建(jian)筑業用工制度和勞務分包制度。
要在科學發展觀指導下,通過政府、協會、企業和社會各界共同努力,進一步完善建筑勞務公司用工(gong)和(he)分包制度,盡快實(shi)現“企業(ye)(ye)用工(gong)規(gui)范化(hua)、從(cong)業(ye)(ye)人員產業(ye)(ye)化(hua)、勞務分包企業(ye)(ye)化(hua)”的目(mu)標。
(一)實現建筑企業用工規范化(hua)
建(jian)筑企業用工行為(wei)不規范,是(shi)導致建(jian)筑勞(lao)務(wu)(wu)市場發展緩慢(man)的關鍵所在。因(yin)此,要建(jian)立建(jian)筑勞(lao)務(wu)(wu)分包監督檢(jian)查機制,加強對用工行為(wei)的檢(jian)查,指導規范勞(lao)務(wu)(wu)分包活動,積極利用信息化手(shou)段(duan),推動農民工實名管理制度(du)。
1.總承包企業
總(zong)承包企業(ye)(ye)對勞(lao)(lao)(lao)務(wu)分包企業(ye)(ye)勞(lao)(lao)(lao)務(wu)作業(ye)(ye)和用工(gong)情況(kuang)負有監督管(guan)理(li)責任。對因(yin)(yin)工(gong)程項目違(wei)法(fa)分包、非法(fa)用工(gong)、勞(lao)(lao)(lao)務(wu)管(guan)理(li)不善(shan)等原因(yin)(yin)導致(zhi)的(de)質(zhi)量、安全問題,以及因(yin)(yin)勞(lao)(lao)(lao)務(wu)糾紛引(yin)發的(de)群體事(shi)件承擔連(lian)帶貴任。
總承(cheng)包企(qi)業必(bi)(bi)須(xu)加強對(dui)(dui)工(gong)(gong)程項目的用(yong)工(gong)(gong)管(guan)理(li)。總承(cheng)包企(qi)業必(bi)(bi)須(xu)建立(li)勞(lao)務(wu)作業管(guan)理(li)制(zhi)度。應設立(li)內部勞(lao)務(wu)管(guan)理(li)部門(men),建立(li)公(gong)開公(gong)平的勞(lao)務(wu)招標制(zhi)度,對(dui)(dui)勞(lao)務(wu)分包合(he)同(tong)的履約悄(qiao)況進(jin)行(xing)動態監管(guan),對(dui)(dui)農(nong)(nong)民(min)(min)工(gong)(gong)工(gong)(gong)資(zi)發放進(jin)行(xing)全(quan)過程的監督管(guan)理(li)。必(bi)(bi)須(xu)建立(li)農(nong)(nong)民(min)(min)工(gong)(gong)實名制(zhi)管(guan)理(li)制(zhi)度,對(dui)(dui)農(nong)(nong)民(min)(min)工(gong)(gong)身份、勞(lao)動合(he)同(tong)、工(gong)(gong)資(zi)發放、持證上崗、工(gong)(gong)傷保險等悄(qiao)況進(jin)行(xing)規范管(guan)理(li)。改善農(nong)(nong)民(min)(min)工(gong)(gong)生(sheng)產生(sheng)活條件,豐富農(nong)(nong)民(min)(min)工(gong)(gong)的精(jing)神(shen)文(wen)化生(sheng)活。
2.勞(lao)務分(fen)包企業
爭勞(lao)務(wu)分包企(qi)業(ye)管理人員(yuan)要(yao)學習和掌(zhang)握相關(guan)法律法規(gui)、職(zhi)(zhi)業(ye)技能(neng)知識,不(bu)斷提(ti)高勞(lao)務(wu)分包管理水平。要(yao)建立(li)健全規(gui)章制度,與雇用(yong)農(nong)(nong)民(min)(min)工簽(qian)訂書面勞(lao)動(dong)合(he)同,建立(li)合(he)法勞(lao)動(dong)關(guan)系,嚴(yan)格執行持證上崗制度,要(yao)設專(zhuan)職(zhi)(zhi)勞(lao)資管理員(yuan)負責農(nong)(nong)民(min)(min)工的記工、考(kao)勤、工資發放等(deng)事項(xiang),有(you)條件(jian)的還應設專(zhuan)職(zhi)(zhi)技術員(yuan),指導農(nong)(nong)民(min)(min)工參(can)加技能(neng)培訓和鑒定,提(ti)高職(zhi)(zhi)業(ye)技能(neng)水平。
(二)實現勞務從業人員產(chan)業化
黨中央、國務院明確指出,進城就業(ye)的(de)(de)農(nong)村(cun)(cun)勞(lao)動力已成(cheng)(cheng)為(wei)我國產業(ye)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)(ren)的(de)(de)重要(yao)組成(cheng)(cheng)部分。所(suo)謂(wei)產業(ye)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)(ren),指在現代企業(ye)中從事集體生(sheng)產勞(lao)動,以(yi)工(gong)(gong)(gong)(gong)資收人(ren)(ren)(ren)(ren)為(wei)生(sheng)活來源的(de)(de)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)(ren)。產業(ye)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)(ren)具(ju)有(you)組織性(xing)、紀律性(xing)和革(ge)命性(xing),是工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)(ren)階級的(de)(de)主力和骨干,是先進生(sheng)產力的(de)(de)代表者,隨(sui)著農(nong)業(ye)和農(nong)村(cun)(cun)經濟結(jie)構的(de)(de)調整、工(gong)(gong)(gong)(gong)業(ye)化(hua)的(de)(de)推進和城鎮化(hua)的(de)(de)提(ti)速,現在已有(you)超過1/3的(de)(de)農(nong)村(cun)(cun)勞(lao)動力轉移到非農(nong)產業(ye).這標志(zhi)著我國工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)(ren)隊伍構成(cheng)(cheng)發生(sheng)歷史性(xing)變化(hua)。農(nong)業(ye)戶口(kou)的(de)(de)勞(lao)動力在數足上已經超過城市(shi)戶口(kou)的(de)(de)勞(lao)動力
產(chan)(chan)業大軍,建筑業還(huan)有(you)很長(chang)的(de)路(lu)要走。成為產(chan)(chan)業工(gong)人的(de)主體(ti)。但要培育成為合格的(de)產(chan)(chan)業大軍。
1.大力推進(jin)勞務企業化,全面推行勞動合(he)同制度
第(di)一,不斷推(tui)進(jin)建筑業(ye)(ye)農民工(gong)勞(lao)(lao)動(dong)組織法(fa)人化(hua)(hua)、正規化(hua)(hua)建設。充分發揮政府(fu)在規范市場(chang)中不可替代的(de)作(zuo)用,加快勞(lao)(lao)務(wu)(wu)企(qi)業(ye)(ye)的(de)建設。鼓(gu)勵(li)包(bao)(bao)工(gong)頭帶領的(de)施(shi)工(gong)隊向正規勞(lao)(lao)務(wu)(wu)公司(si)轉變(bian),強化(hua)(hua)勞(lao)(lao)務(wu)(wu)公司(si)的(de)法(fa)人地位,建立勞(lao)(lao)務(wu)(wu)分包(bao)(bao)交易平臺,嚴厲打擊非(fei)法(fa)用工(gong)、非(fei)法(fa)轉包(bao)(bao)行為(wei)。同(tong)時,各類(lei)企(qi)業(ye)(ye)均(jun)可成(cheng)為(wei)用人主體(ti)二(er)按照《就業(ye)(ye)促(cu)進(jin)法(fa)》的(de)要求(qiu),鼓(gu)勵(li)各類(lei)建筑企(qi)業(ye)(ye),尤其是眾多專業(ye)(ye)承(cheng)包(bao)(bao)企(qi)業(ye)(ye)直接雇用技術(shu)工(gong)人。各類(lei)企(qi)業(ye)(ye)雇用務(wu)(wu)工(gong)人員,均(jun)應遵守(shou)國家勞(lao)(lao)動(dong)法(fa)規。引(yin)導承(cheng)包(bao)(bao)企(qi)業(ye)(ye)分離勞(lao)(lao)務(wu)(wu)作(zuo)業(ye)(ye)層,推(tui)行勞(lao)(lao)務(wu)(wu)分包(bao)(bao)制度。
第二(er),穩步推(tui)行勞動(dong)合同(tong)制度。建(jian)筑勞務(wu)企業作為集氣(qi)“用人(ren)”與嚴用工(gong)”于一身的市場(chang)主(zhu)體(ti),必須直接與所雇用的勞動(dong)者簽訂(ding)勞動(dong)合同(tong),切(qie)實粗行用人(ren)單(dan)位(wei)的責任和義務(wu)。
2.改(gai)善(shan)就業環境(jing),加快建筑(zhu)業農民工(gong)(gong)社(she)會(hui)保障的制度(du)化(hua)建設,吸(xi)引務(wu)工(gong)(gong)人(ren)員(yuan)從事建筑(zhu)業。切實改(gai)善(shan)務(wu)工(gong)(gong)人(ren)員(yuan)的待遇,實行(xing)同工(gong)(gong)同酬;除健全(quan)勞動合同制度(du),推行(xing)工(gong)(gong)傷(shang)、醫療保險外,積極為務(wu)工(gong)(gong)人(ren)員(yuan)辦(ban)理基本社(she)會(hui)保險,切實改(gai)善(shan)務(wu)工(gong)(gong)人(ren)員(yuan)生產(chan)生活條件。豐富務(wu)工(gong)(gong)人(ren)員(yuan)的精神文化(hua)生活;依托(tuo)地(di)方和總承包企(qi)業,扶持建筑(zhu)勞務(wu)企(qi)業建立黨(dang)團和工(gong)(gong)會(hui)組織。
3.廣泛(fan)開展(zhan)技(ji)能培(pei)(pei)(pei)訓(xun)(xun)與鑒定(ding)(ding),提(ti)高務工(gong)人員(yuan)素質(zhi)。要繼(ji)續堅(jian)持(chi)“政府主(zhu)導,社會參與,機制靈(ling)活,監(jian)管有力”的(de)原則,構筑新型的(de)農(nong)民工(gong)培(pei)(pei)(pei)訓(xun)(xun)體制架(jia)構,調動(dong)各方面(mian)的(de)積極(ji)性,將農(nong)民工(gong)的(de)培(pei)(pei)(pei)訓(xun)(xun)分(fen)(fen)為純(chun)公益性質(zhi)的(de)培(pei)(pei)(pei)訓(xun)(xun)和準公益性質(zhi)的(de)培(pei)(pei)(pei)訓(xun)(xun)兩(liang)類(lei),分(fen)(fen)別界定(ding)(ding)培(pei)(pei)(pei)訓(xun)(xun)主(zhu)體,大力發(fa)揮行業組織在(zai)農(nong)民工(gong)技(ji)能培(pei)(pei)(pei)訓(xun)(xun)中的(de)作用,推(tui)進(jin)技(ji)能培(pei)(pei)(pei)訓(xun)(xun)和鑒定(ding)(ding)工(gong)作。
一是保證培(pei)訓(xun)經費來源,多途徑開展培(pei)訓(xun)工作(zuo)
二是社(she)會和(he)(he)行業(ye)(ye)各方面(mian)應(ying)履行責任(ren),發揮自身(shen)優勢,積(ji)極(ji)參與(yu)建(jian)筑業(ye)(ye)務工(gong)(gong)(gong)人(ren)(ren)員(yuan)(yuan)(yuan)技(ji)能(neng)培訓(xun)(xun)(xun)與(yu)鑒(jian)(jian)定(ding)。勞(lao)(lao)務輸(shu)出(chu)縣(市)應(ying)源頭上重點(dian)開(kai)(kai)展(zhan)建(jian)筑業(ye)(ye)務工(gong)(gong)(gong)人(ren)(ren)員(yuan)(yuan)(yuan)的初級培訓(xun)(xun)(xun),做(zuo)到“先培訓(xun)(xun)(xun)、后輸(shu)出(chu)”。總承包企(qi)(qi)業(ye)(ye)應(ying)通(tong)過(guo)建(jian)設農民工(gong)(gong)(gong)業(ye)(ye)余學校,結(jie)合工(gong)(gong)(gong)程(cheng)施工(gong)(gong)(gong)的需要開(kai)(kai)展(zhan)用工(gong)(gong)(gong)人(ren)(ren)員(yuan)(yuan)(yuan)的安全(quan)教育和(he)(he)補充性(xing)技(ji)能(neng)培訓(xun)(xun)(xun),專業(ye)(ye)承包企(qi)(qi)業(ye)(ye)和(he)(he)建(jian)筑勞(lao)(lao)務企(qi)(qi)業(ye)(ye)首先應(ying)做(zuo)好(hao)組織(zhi)(zhi)工(gong)(gong)(gong)作,安排務工(gong)(gong)(gong)人(ren)(ren)員(yuan)(yuan)(yuan)參加(jia)有關(guan)方面(mian)組織(zhi)(zhi)的技(ji)能(neng)培訓(xun)(xun)(xun)和(he)(he)技(ji)能(neng)鑒(jian)(jian)定(ding)。今后應(ying)將所(suo)招用務工(gong)(gong)(gong)人(ren)(ren)員(yuan)(yuan)(yuan)視為(wei)企(qi)(qi)業(ye)(ye)職工(gong)(gong)(gong),履行培訓(xun)(xun)(xun)責任(ren);務工(gong)(gong)(gong)人(ren)(ren)員(yuan)(yuan)(yuan)應(ying)積(ji)極(ji)參加(jia)技(ji)能(neng)培訓(xun)(xun)(xun),通(tong)過(guo)技(ji)能(neng)鑒(jian)(jian)定(ding),提高自身(shen)技(ji)術素質和(he)(he)工(gong)(gong)(gong)薪待遇。務工(gong)(gong)(gong)人(ren)(ren)員(yuan)(yuan)(yuan)晉(jin)升技(ji)能(neng)等級,應(ying)自行承擔培訓(xun)(xun)(xun)和(he)(he)技(ji)能(neng)鑒(jian)(jian)定(ding)費用。
三是對建(jian)(jian)筑(zhu)勞務企業(ye)(ye)管理人(ren)員(yuan)實行崗位(wei)培訓和持證上崗制(zhi)(zhi)度(du),培養工長等方面的管理人(ren)才.建(jian)(jian)立技(ji)能檔案(an)制(zhi)(zhi)度(du),通過(guo)建(jian)(jian)立建(jian)(jian)筑(zhu)業(ye)(ye)務工人(ren)員(yuan)的技(ji)能檔案(an)和信息查詢系(xi)統,實現技(ji)術工人(ren)技(ji)能證書地(di)區與企業(ye)(ye)之(zhi)間的互(hu)認(ren),便(bian)于技(ji)術工人(ren)合(he)理流動。
(三)扶持勞(lao)務分包企業發展(zhan)
改善勞務分包企業發展環境(jing),從(cong)不同(tong)層面(mian)予以扶持和指(zhi)導(dao)。
1.堅持專業(ye)(ye)(ye)化、小型化的方向(xiang),合理控(kong)制建(jian)筑勞(lao)務企(qi)業(ye)(ye)(ye)規棋。建(jian)筑勞(lao)務企(qi)業(ye)(ye)(ye)要適度規模(mo)經營(ying)。要嚴格(ge)界定總承(cheng)包企(qi)業(ye)(ye)(ye)與勞(lao)務分包企(qi)業(ye)(ye)(ye)的責任。
2.拓寬勞務(wu)(wu)企業(ye)(ye)(ye)(ye)的(de)經(jing)營(ying)領域(yu),增強經(jing)濟實(shi)力(li)和(he)自我生存能(neng)力(li)。在不違背現行法(fa)律的(de)條件下,鼓勵企業(ye)(ye)(ye)(ye)將勞務(wu)(wu)分(fen)包作業(ye)(ye)(ye)(ye)與相關工(gong)(gong)程業(ye)(ye)(ye)(ye)務(wu)(wu)的(de)敲合。催生一批具(ju)有施工(gong)(gong)操作技術、施工(gong)(gong)機(ji)具(ju)設備、加(jia)工(gong)(gong)制作能(neng)力(li)的(de)新型專業(ye)(ye)(ye)(ye)化勞務(wu)(wu)分(fen)包企業(ye)(ye)(ye)(ye),成為(wei)工(gong)(gong)程分(fen)包的(de)合格(ge)市(shi)場主體、建筑(zhu)產業(ye)(ye)(ye)(ye)工(gong)(gong)人(ren)就業(ye)(ye)(ye)(ye)的(de)有效載體。引導建筑(zhu)勞務(wu)(wu)企業(ye)(ye)(ye)(ye)逐步(bu)成為(wei)具(ju)有專業(ye)(ye)(ye)(ye)施工(gong)(gong)能(neng)力(li)的(de)合格(ge)的(de)市(shi)場主體。
3.制(zhi)定(ding)勞(lao)務(wu)分包(bao)(bao)計價(jia)辦法,規范建筑勞(lao)務(wu)企業(ye)競(jing)爭(zheng)行為.建議政(zheng)府工(gong)程造價(jia)管(guan)理部(bu)門對勞(lao)務(wu)分包(bao)(bao)費用的構成作出規定(ding).調高定(ding)額(e)人(ren)工(gong)費標準,以定(ding)額(e)人(ren)工(gong)費為基礎,確定(ding)建筑勞(lao)務(wu)企業(ye)管(guan)理費、合理利潤、培訓經(jing)費等(deng)取費費率。為勞(lao)務(wu)分包(bao)(bao)合同備案等(deng)方(fang)式的行政(zheng)監管(guan)提(ti)供依據(ju),保障建筑勞(lao)務(wu)企業(ye)合理利益。
4.加強引(yin)導和服(fu)務(wu),大力發展(zhan)勞務(wu)基地
一是(shi)大力發展勞(lao)(lao)(lao)務(wu)基地.成(cheng)建制摘(zhai)出建筑(zhu)勞(lao)(lao)(lao)務(wu)。鼓勵建筑(zhu)勞(lao)(lao)(lao)務(wu)拍出地區選擇勞(lao)(lao)(lao)務(wu)資(zi)源豐富的縣(市(shi))設立建筑(zhu)勞(lao)(lao)(lao)務(wu)基地。做好(hao)農村轉移勞(lao)(lao)(lao)動力的組織(zhi)和(he)服務(wu)工(gong)作;二是(shi)鼓勵用工(gong)企業參與勞(lao)(lao)(lao)務(wu)基地建設。
在全面建(jian)(jian)設小康社會.實(shi)現(xian)中華民族的偉(wei)大(da)(da)復興中,建(jian)(jian)筑(zhu)業肩負(fu)現(xian)代化(hua)建(jian)(jian)設先行軍(jun)的重(zhong)大(da)(da)責任(ren)。不負(fu)歷史和人(ren)民的重(zhong)托,履行好這一(yi)職貴(gui),重(zhong)要的工(gong)作之一(yi)是加快(kuai)改革創新建(jian)(jian)筑(zhu)企業用工(gong)制度和分包制度,建(jian)(jian)設一(yi)支宏大(da)(da)的建(jian)(jian)筑(zhu)業產業工(gong)人(ren)大(da)(da)軍(jun),夯實(shi)中國建(jian)(jian)筑(zhu)業發展的基礎。
