國家用工層面建筑勞務用工政策解讀

  在我國建筑行業,農民工已經成為施工第一線的操作主體。國務院在2006年3月27日發布了《關于解決農民工問題的若干意見》,全面系統地提出了解決農民工問題的大政方針,這是國家層面的適用于建筑勞務公司勞務用工管理(li)的最高政策(ce)文件汁文件的主要內容如下:

國家用工層面建筑勞務用工政策解讀

  一、充分認識解決(jue)好農(nong)民工問題的(de)重大意義

  (一)農(nong)(nong)民(min)工問題事關我國經(jing)濟(ji)和(he)社(she)(she)會(hui)發(fa)展全局.農(nong)(nong)民(min)工分布在(zai)國民(min)經(jing)濟(ji)各個行業(ye)(ye),在(zai)加(jia)(jia)工制造業(ye)(ye)、建筑(zhu)業(ye)(ye)、采掘業(ye)(ye)及環衛、家政、餐飲等服務(wu)業(ye)(ye)中已占從業(ye)(ye)人員半數(shu)以(yi)上,是推(tui)動我國經(jing)濟(ji)社(she)(she)會(hui)發(fa)展的(de)(de)重(zhong)要力量。農(nong)(nong)民(min)外出務(wu)工,為(wei)城(cheng)市(shi)(shi)創造了(le)財富(fu),為(wei)農(nong)(nong)村(cun)增加(jia)(jia)了(le)收人,為(wei)城(cheng)鄉(xiang)發(fa)展注(zhu)人了(le)活力,成為(wei)工業(ye)(ye)帶(dai)動農(nong)(nong)業(ye)(ye)、城(cheng)市(shi)(shi)帶(dai)動農(nong)(nong)村(cun)、發(fa)達地區帶(dai)動落后地區的(de)(de)有(you)效形式,同時促(cu)進了(le)市(shi)(shi)場導(dao)向(xiang)、自主擇(ze)業(ye)(ye)、競(jing)爭(zheng)就業(ye)(ye)機制的(de)(de)形成,為(wei)改變城(cheng)鄉(xiang)二元結構、解(jie)決(jue)“三農(nong)(nong)”問題闖出了(le)一條新路。返鄉(xiang)創業(ye)(ye)的(de)(de)農(nong)(nong)民(min)工,帶(dai)回資金、技術(shu)和(he)市(shi)(shi)場經(jing)濟(ji)觀念,直接促(cu)進社(she)(she)會(hui)主義新農(nong)(nong)村(cun)建設。進一步做(zuo)好農(nong)(nong)民(min)工工作,對于改革發(fa)展穩定(ding)的(de)(de)全局和(he)順利推(tui)進工業(ye)(ye)化(hua)、城(cheng)鎮(zhen)化(hua)、現代(dai)化(hua)都具有(you)重(zhong)大意義。

  (二)維(wei)護(hu)農(nong)(nong)民(min)(min)工(gong)權益是(shi)需要解決的突(tu)出(chu)問題。近年來,黨中央二國(guo)務院高度重視農(nong)(nong)民(min)(min)工(gong)問題,制定(ding)了(le)一系(xi)列保障農(nong)(nong)民(min)(min)工(gong)權益和(he)改善(shan)農(nong)(nong)民(min)(min)工(gong)就業環境的政策措施(shi),各地(di)區、各部門做了(le)大量工(gong)作(zuo),取得(de)(de)了(le)明顯成效。但(dan)農(nong)(nong)民(min)(min)工(gong)面臨(lin)的問題仍然十(shi)分突(tu)出(chu)。主要是(shi):工(gong)資(zi)偏低(di),被拖欠現(xian)象(xiang)嚴(yan)重;勞動時間(jian)長,安(an)全條件(jian)差(cha);缺乏社會保障,職業病和(he)工(gong)傷事故多;培訓(xun)就業、子女上學、生活居住(zhu)等方面也存在諸多困難,經(jing)濟二政治、文化權益得(de)(de)不到(dao)有效保障。這些問題引發了(le)不少社會矛盾和(he)糾(jiu)紛。解決好這些問題,直接(jie)關系(xi)到(dao)維(wei)護(hu)社會公(gong)平(ping)正義,保持社會和(he)諧穩定(ding)。

  (三)解決農民(min)(min)工問題是建(jian)設中(zhong)國(guo)特(te)色社會主義的(de)戰(zhan)略任務。農業(ye)勞動(dong)力向非農產業(ye)和(he)城(cheng)(cheng)鎮(zhen)轉移,是世界(jie)各(ge)國(guo)工業(ye)化(hua)、城(cheng)(cheng)鎮(zhen)化(hua)的(de)普(pu)遍趨勢,也是農業(ye)現(xian)代化(hua)的(de)必然要(yao)求‘我國(guo)農村勞動(dong)力數量眾多(duo),在工業(ye)化(hua)、城(cheng)(cheng)鎮(zhen)化(hua)加快(kuai)發展的(de)階段,越來(lai)越多(duo)的(de)富余(yu)勞動(dong)力將(jiang)(jiang)逐(zhu)漸(jian)轉移出來(lai),大量農民(min)(min)工在城(cheng)(cheng)鄉之間流動(dong)就業(ye)的(de)現(xian)象在我國(guo)將(jiang)(jiang)長期存在,必須從我國(guo)國(guo)情出發,順應工業(ye)化(hua)、城(cheng)(cheng)鎮(zhen)化(hua)的(de)客觀規律(lv),引導農村富余(yu)勞動(dong)力向非農產業(ye)和(he)城(cheng)(cheng)鎮(zhen)有序轉移。

  我們要站在建(jian)設中國特色社會主(zhu)義事業(ye)全局(ju)和(he)戰略的高度,充分認識解決好農民工問題(ti)的性(xing)、重要緊迫性(xing)和(he)長期性(xing)。

  二、做好農民工工作的指導(dao)思想(xiang)和基本原(yuan)則

  (一)指導(dao)思(si)想(xiang)。以鄧小平理論(lun)和(he)(he)“三個代表(biao)”重(zhong)要思(si)想(xiang)為指導(dao).按照落實科(ke)學發展觀(guan)和(he)(he)構建(jian)杜會(hui)主義和(he)(he)諧社會(hui)的(de)(de)要求,堅持(chi)解放思(si)想(xiang),實事求是(shi),與時俱進。堅持(chi)從我國國情出(chu)發,統(tong)(tong)籌城(cheng)鄉(xiang)發展;堅持(chi)以人為本,認真解決涉及農(nong)(nong)(nong)民(min)(min)工(gong)利益的(de)(de)問題。著力完善政策(ce)(ce)和(he)(he)管理,推進體制(zhi)(zhi)改(gai)革和(he)(he)制(zhi)(zhi)度創新.逐(zhu)步建(jian)立(li)(li)城(cheng)鄉(xiang)統(tong)(tong)一的(de)(de)勞(lao)動力市(shi)場(chang)和(he)(he)公(gong)平競爭的(de)(de)就(jiu)業制(zhi)(zhi)度。建(jian)立(li)(li)保(bao)障農(nong)(nong)(nong)民(min)(min)工(gong)合法權益的(de)(de)政策(ce)(ce)體系和(he)(he)執法監份機制(zhi)(zhi),建(jian)立(li)(li)惠及農(nong)(nong)(nong)民(min)(min)工(gong)的(de)(de)城(cheng)鄉(xiang)公(gong)共服務體制(zhi)(zhi)和(he)(he)制(zhi)(zhi)度,拓寬農(nong)(nong)(nong)村勞(lao)動轉(zhuan)移就(jiu)業集道,保(bao)護和(he)(he)調動農(nong)(nong)(nong)民(min)(min)工(gong)的(de)(de)積極性,促進城(cheng)鄉(xiang)經濟(ji)策(ce)(ce)榮和(he)(he)社會(hui)全面進步,推動社會(hui)主義新農(nong)(nong)(nong)村建(jian)設和(he)(he)中國特色的(de)(de)工(gong)業化、城(cheng)鎮(zhen)化、現代化健康(kang)發展。

  (二)基(ji)本原(yuan)則。

  —公(gong)平(ping)對待,一視(shi)同仁。尊重和(he)維(wei)護農民工(gong)的(de)合法權益,消除對農民進城務(wu)工(gong)的(de)歧視(shi)性規定和(he)體制性障礙,使他們和(he)城市職工(gong)享有同等的(de)權利和(he)義務(wu)。

  —強化服務(wu),完(wan)善(shan)管理.轉變(bian)政府(fu)職能,加強和改善(shan)對(dui)農(nong)民(min)工(gong)(gong)的公(gong)共服務(wu)和社(she)會管理,發揮企業、社(she)區和中介組織(zhi)作用,為農(nong)民(min)工(gong)(gong)生(sheng)活與勞動(dong)創造良好環(huan)境和有(you)利(li)條件。

  —統籌(chou)規劃,合理(li)引導(dao)。實行農村勞(lao)動力異(yi)地(di)轉(zhuan)移與就(jiu)地(di)轉(zhuan)移相結合。既(ji)要(yao)積(ji)極引導(dao)農民進城(cheng)務(wu)工,又要(yao)大(da)(da)力發展(zhan)鄉鎮(zhen)企(qi)業(ye)和縣域經濟,擴大(da)(da)農村勞(lao)動力在(zai)當(dang)地(di)轉(zhuan)移就(jiu)業(ye)。

  —因(yin)地(di)(di)(di)(di)制宜,分類指導。翰(han)出地(di)(di)(di)(di)和箱(xiang)入地(di)(di)(di)(di)都要有針對性地(di)(di)(di)(di)解決(jue)農(nong)民工(gong)面臨的(de)各種問題(ti)。鼓勵各地(di)(di)(di)(di)區從實際出發,探索保護農(nong)民工(gong)權益、促進農(nong)村富余勞(lao)動(dong)力(li)有序(xu)流(liu)動(dong)的(de)辦法(fa)。

  —立(li)足當(dang)前,著眼長遠(yuan)。既要抓緊解決農(nong)民工面臨的突出問(wen)(wen)題,又要依靠改革和發展,逐(zhu)步解決深層次問(wen)(wen)題,形成(cheng)從根本上(shang)保障(zhang)農(nong)民工權(quan)益的體制(zhi)和制(zhi)度。

  三、抓緊解決(jue)農(nong)民工(gong)工(gong)資偏低(di)和拖欠問(wen)題

  (一)建立農民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)支付保(bao)(bao)障(zhang)制(zhi)(zhi)度(du)。嚴格規范用人(ren)(ren)(ren)單(dan)(dan)位(wei)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)支付行為,確保(bao)(bao)農民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)按時足頰(jia)發放(fang)給本(ben)(ben)人(ren)(ren)(ren),做到(dao)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)發放(fang)月清月結(jie)或按勞動合同約定(ding)執(zhi)行。建立工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)支付監控制(zhi)(zhi)度(du)和工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)保(bao)(bao)證(zheng)金(jin)(jin)制(zhi)(zhi)度(du),從根本(ben)(ben)上(shang)解(jie)決(jue)拖(tuo)(tuo)欠(qian)、克(ke)扣農民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)問題。勞動保(bao)(bao)障(zhang)部(bu)門要(yao)重(zhong)點監控農民工(gong)(gong)(gong)(gong)(gong)集(ji)中(zhong)的用人(ren)(ren)(ren)單(dan)(dan)位(wei)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)發放(fang)悄況。對(dui)發生(sheng)過(guo)拖(tuo)(tuo)欠(qian)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)的用人(ren)(ren)(ren)單(dan)(dan)位(wei).強制(zhi)(zhi)在開戶銀行按期預存工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)保(bao)(bao)證(zheng)金(jin)(jin),實行專戶管理。切實解(jie)決(jue)政(zheng)府投(tou)資(zi)(zi)(zi)(zi)項(xiang)目拖(tuo)(tuo)欠(qian)工(gong)(gong)(gong)(gong)(gong)程(cheng)款(kuan)(kuan)問題。所(suo)有建設單(dan)(dan)位(wei)都要(yao)按照(zhao)合同約定(ding)及時撥(bo)付工(gong)(gong)(gong)(gong)(gong)程(cheng)款(kuan)(kuan)項(xiang),建設資(zi)(zi)(zi)(zi)金(jin)(jin)不(bu)落(luo)實的,有關部(bu)門不(bu)得發放(fang)施(shi)工(gong)(gong)(gong)(gong)(gong)許可證(zheng),不(bu)得批準(zhun)開工(gong)(gong)(gong)(gong)(gong)報告。對(dui)重(zhong)點監控的建筑施(shi)工(gong)(gong)(gong)(gong)(gong)企業(ye)實行工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)保(bao)(bao)證(zheng)金(jin)(jin)制(zhi)(zhi)度(du)。加(jia)大對(dui)拖(tuo)(tuo)欠(qian)農民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)的用人(ren)(ren)(ren)單(dan)(dan)位(wei)的處罰力度(du),對(dui)惡憊拖(tuo)(tuo)欠(qian)、悄節嚴重(zhong)的.可依法貴令停業(ye)整(zheng)頓、降低或取消資(zi)(zi)(zi)(zi)質。直至吊銷營業(ye)執(zhi)照(zhao),并(bing)對(dui)有關人(ren)(ren)(ren)員依法予(yu)以制(zhi)(zhi)裁。各地方、各單(dan)(dan)位(wei)都要(yao)繼續加(jia)大工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)清欠(qian)力度(du),并(bing)確保(bao)(bao)不(bu)發生(sheng)新的拖(tuo)(tuo)欠(qian)。

  (二)合理確定(ding)(ding)和(he)(he)提(ti)高農民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)水平。規范農民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)管理,切實改變(bian)農民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)偏(pian)低(di)(di)(di)、同(tong)工(gong)(gong)(gong)(gong)不同(tong)酬(chou)的(de)(de)狀況。各地(di)要(yao)嚴(yan)格執行(xing)(xing)(xing)(xing)最(zui)(zui)低(di)(di)(di)工(gong)(gong)(gong)(gong)資(zi)(zi)制(zhi)(zhi)度(du),合理確定(ding)(ding)并適時調整最(zui)(zui)低(di)(di)(di)工(gong)(gong)(gong)(gong)資(zi)(zi)標準(zhun)(zhun),制(zhi)(zhi)定(ding)(ding)和(he)(he)推行(xing)(xing)(xing)(xing)小時最(zui)(zui)低(di)(di)(di)工(gong)(gong)(gong)(gong)資(zi)(zi)標準(zhun)(zhun)。制(zhi)(zhi)定(ding)(ding)相(xiang)(xiang)關崗位勞(lao)(lao)動定(ding)(ding)額的(de)(de)行(xing)(xing)(xing)(xing)業參考標準(zhun)(zhun)。用人(ren)單位不得(de)以(yi)實行(xing)(xing)(xing)(xing)計(ji)件工(gong)(gong)(gong)(gong)資(zi)(zi)為由拒絕執行(xing)(xing)(xing)(xing)最(zui)(zui)低(di)(di)(di)工(gong)(gong)(gong)(gong)資(zi)(zi)制(zhi)(zhi)度(du),不得(de)利(li)用提(ti)高勞(lao)(lao)動定(ding)(ding)額變(bian)相(xiang)(xiang)降低(di)(di)(di)工(gong)(gong)(gong)(gong)資(zi)(zi)水平。嚴(yan)格執行(xing)(xing)(xing)(xing)國家(jia)關于職(zhi)工(gong)(gong)(gong)(gong)休(xiu)息休(xiu)假的(de)(de)規定(ding)(ding),延長工(gong)(gong)(gong)(gong)時和(he)(he)休(xiu)息日、法定(ding)(ding)假日工(gong)(gong)(gong)(gong)作的(de)(de),要(yao)依法支付加班工(gong)(gong)(gong)(gong)資(zi)(zi).農民工(gong)(gong)(gong)(gong)和(he)(he)其他職(zhi)工(gong)(gong)(gong)(gong)要(yao)實行(xing)(xing)(xing)(xing)同(tong)工(gong)(gong)(gong)(gong)同(tong)酬(chou)。國務院有關部門要(yao)加強對地(di)方制(zhi)(zhi)定(ding)(ding)、調整和(he)(he)執行(xing)(xing)(xing)(xing)最(zui)(zui)低(di)(di)(di)工(gong)(gong)(gong)(gong)資(zi)(zi)標準(zhun)(zhun)的(de)(de)指(zhi)導監督。各地(di)要(yao)科學確定(ding)(ding)工(gong)(gong)(gong)(gong)資(zi)(zi)指(zhi)導線,建立企業工(gong)(gong)(gong)(gong)資(zi)(zi)集體協商制(zhi)(zhi)度(du),促進農民工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)(zi)合理增長。
