中(zhong)國(guo)的(de)(de)法(fa)(fa)律法(fa)(fa)規對(dui)建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)的(de)(de)勞(lao)(lao)(lao)(lao)務(wu)分(fen)(fen)包(bao)(bao)(bao)(bao)并沒(mei)有(you)詳盡(jin)的(de)(de)規定(ding),建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)勞(lao)(lao)(lao)(lao)務(wu)僅(jin)有(you)建(jian)(jian)(jian)(jian)(jian)(jian)設(she)部(bu)的(de)(de)部(bu)門規章《建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)業(ye)企(qi)業(ye)資(zi)(zi)質(zhi)管(guan)理(li)規定(ding)》、最高(gao)人(ren)民法(fa)(fa)院《最高(gao)人(ren)民法(fa)(fa)院關(guan)于(yu)審理(li)建(jian)(jian)(jian)(jian)(jian)(jian)設(she)工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)施(shi)工(gong)(gong)(gong)(gong)(gong)合同糾紛案件適(shi)用(yong)(yong)(yong)法(fa)(fa)律問題的(de)(de)解(jie)釋》。2005年(nian)建(jian)(jian)(jian)(jian)(jian)(jian)設(she)部(bu)又發布(bu)了一個(ge)《建(jian)(jian)(jian)(jian)(jian)(jian)設(she)部(bu)關(guan)于(yu)建(jian)(jian)(jian)(jian)(jian)(jian)立和(he)完(wan)善勞(lao)(lao)(lao)(lao)務(wu)分(fen)(fen)包(bao)(bao)(bao)(bao)制(zhi)度(du)發展建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)勞(lao)(lao)(lao)(lao)務(wu)企(qi)業(ye)的(de)(de)意(yi)見(jian)》。該(gai)(gai)意(yi)見(jian)指導(dao)思想意(yi)在(zai)以(yi)發展勞(lao)(lao)(lao)(lao)務(wu)企(qi)業(ye)為(wei)突(tu)破(po)口,建(jian)(jian)(jian)(jian)(jian)(jian)設(she)預防建(jian)(jian)(jian)(jian)(jian)(jian)設(she)領域拖欠(qian)農(nong)民工(gong)(gong)(gong)(gong)(gong)公司的(de)(de)長效機(ji)制(zhi),規范(fan)建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)市場秩序(xu),建(jian)(jian)(jian)(jian)(jian)(jian)立和(he)完(wan)善勞(lao)(lao)(lao)(lao)務(wu)分(fen)(fen)包(bao)(bao)(bao)(bao)制(zhi)度(du),調整全行業(ye)建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)隊伍(wu)組織結構,提高(gao)勞(lao)(lao)(lao)(lao)務(wu)隊伍(wu)的(de)(de)職(zhi)業(ye)素質(zhi),保(bao)障工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)質(zhi)量和(he)安全。該(gai)(gai)意(yi)見(jian)的(de)(de)工(gong)(gong)(gong)(gong)(gong)作目(mu)標,從2005年(nian)7月1日起,用(yong)(yong)(yong)三年(nian)的(de)(de)時間,在(zai)全國(guo)建(jian)(jian)(jian)(jian)(jian)(jian)立基(ji)本規范(fan)的(de)(de)建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)勞(lao)(lao)(lao)(lao)務(wu)分(fen)(fen)包(bao)(bao)(bao)(bao)制(zhi)度(du),農(nong)民工(gong)(gong)(gong)(gong)(gong)基(ji)本被(bei)勞(lao)(lao)(lao)(lao)務(wu)企(qi)業(ye)或者其他(ta)用(yong)(yong)(yong)工(gong)(gong)(gong)(gong)(gong)企(qi)業(ye)直接吸納,“包(bao)(bao)(bao)(bao)工(gong)(gong)(gong)(gong)(gong)頭”承(cheng)攬分(fen)(fen)包(bao)(bao)(bao)(bao)基(ji)本禁止,為(wei)此還提供(gong)了一系列的(de)(de)政策(ce)措施(shi)譬如(ru)簡化建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)勞(lao)(lao)(lao)(lao)務(wu)分(fen)(fen)包(bao)(bao)(bao)(bao)企(qi)業(ye)資(zi)(zi)質(zhi)審批(pi)程(cheng)(cheng)序(xu)、施(shi)工(gong)(gong)(gong)(gong)(gong)總承(cheng)包(bao)(bao)(bao)(bao)、專業(ye)承(cheng)包(bao)(bao)(bao)(bao)企(qi)業(ye)用(yong)(yong)(yong)工(gong)(gong)(gong)(gong)(gong)必須辦(ban)理(li)社會保(bao)險、加(jia)強對(dui)承(cheng)包(bao)(bao)(bao)(bao)企(qi)業(ye)“職(zhi)工(gong)(gong)(gong)(gong)(gong)教育經費”的(de)(de)使(shi)用(yong)(yong)(yong)監管(guan),加(jia)大農(nong)民工(gong)(gong)(gong)(gong)(gong)職(zhi)業(ye)培訓(xun)資(zi)(zi)金投(tou)入數額等,其目(mu)的(de)(de)就是規范(fan)建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)的(de)(de)勞(lao)(lao)(lao)(lao)務(wu)分(fen)(fen)包(bao)(bao)(bao)(bao)。但中(zhong)國(guo)的(de)(de)建(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)(zhu)工(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)勞(lao)(lao)(lao)(lao)務(wu)分(fen)(fen)包(bao)(bao)(bao)(bao)仍然存在(zai)諸(zhu)多不完(wan)善的(de)(de)方面(mian)。主要原因表現在(zai)以(yi)下幾(ji)個(ge)方面(mian):
1、 規范建(jian)(jian)筑工(gong)(gong)程(cheng)勞務(wu)(wu)分(fen)(fen)包(bao)的法(fa)律(lv)法(fa)規不健全。建(jian)(jian)議(yi)在《建(jian)(jian)筑法(fa)》的修訂(ding)上,充分(fen)(fen)肯定勞務(wu)(wu)分(fen)(fen)包(bao)的法(fa)律(lv)形式(shi),明(ming)確建(jian)(jian)筑工(gong)(gong)程(cheng)勞務(wu)(wu)分(fen)(fen)包(bao)中(zhong)的勞務(wu)(wu)用工(gong)(gong)制度,嚴格禁止“包(bao)工(gong)(gong)頭”承包(bao)勞務(wu)(wu)工(gong)(gong)程(cheng)。
2、 各級(ji)行政主管(guan)部(bu)門(men)對規范建(jian)筑工(gong)程勞務(wu)分包重視(shi)不夠。建(jian)議各級(ji)政府部(bu)門(men)加(jia)強(qiang)勞務(wu)的(de)管(guan)理(li),重視(shi)勞務(wu)企業(ye)的(de)發展(zhan),多(duo)渠道建(jian)立和發展(zhan)勞務(wu)企業(ye)。
3、 勞(lao)務分包制(zhi)度(du)尚不規范,從事建(jian)筑行業的(de)勞(lao)務工(gong)人合法(fa)權利得不到有效保(bao)障。建(jian)議(yi)加強(qiang)勞(lao)動相(xiang)關法(fa)律法(fa)規的(de)宣傳,增強(qiang)勞(lao)務工(gong)人的(de)維權意識,從各個方(fang)面健全勞(lao)務分包制(zhi)度(du)
