解除(chu)、終止(zhi)勞動(dong)合(he)同的補償:
(一(yi))用(yong)人(ren)單(dan)位(wei)與勞(lao)動者解除勞(lao)動合同(tong)要(yao)依(yi)法對勞(lao)動者進行補償(chang)《實(shi)施條(tiao)例》第(di)二(er)十(shi)條(tiao):用(yong)人(ren)單(dan)位(wei)依(yi)照勞(lao)動合同(tong)法第(di)四十(shi)條(tiao)的(de)規(gui)定(ding),選擇額外(wai)支付勞(lao)動者一(yi)個月(yue)(yue)工(gong)資解除勞(lao)動合同(tong)的(de),其額外(wai)支付的(de)工(gong)資應當按照該勞(lao)動者上個月(yue)(yue)的(de)工(gong)資標準確(que)定(ding)。
備注:《勞(lao)動合(he)同法》第四十條:有下列情(qing)形之一(yi)的,用人(ren)單位提前三十日以(yi)(yi)書面形式通知勞(lao)動者本人(ren)或(huo)者額外支付勞(lao)動者一(yi)個月(yue)工(gong)資后,可以(yi)(yi)解(jie)除勞(lao)動合(he)同:
(一)勞動者(zhe)患病或者(zhe)非因工負(fu)傷,在規定的醫療期(qi)滿后不能從事(shi)原工作(zuo),也不能從事(shi)由用人單(dan)位另行安排的工作(zuo)的;
(二)勞(lao)動者(zhe)不能(neng)勝(sheng)(sheng)任工(gong)作,經過培訓或者(zhe)調整工(gong)作崗位,仍不能(neng)勝(sheng)(sheng)任工(gong)作的(de);
(三(san))勞(lao)動合(he)同(tong)訂立時所依據的(de)客觀情況發生重大(da)變化,致(zhi)使勞(lao)動合(he)同(tong)無法履行(xing),經用人單(dan)位(wei)與(yu)勞(lao)動者協商(shang),未(wei)能就變更勞(lao)動合(he)同(tong)內(nei)容達成協議的(de)《實施條例》第二十二條:以完成一定(ding)工(gong)作任務為(wei)期限的(de)勞(lao)動合(he)同(tong)因任務完成而終止的(de),用人單(dan)位(wei)應當依照《勞(lao)動合(he)同(tong)法》第四十七條的(de)規定(ding)向勞(lao)動者支(zhi)付經濟(ji)補償(chang)。
備注:《勞(lao)(lao)(lao)動(dong)合(he)同法》第四(si)十(shi)七(qi)(qi)條(tiao)(tiao):經濟(ji)(ji)補(bu)償(chang)按勞(lao)(lao)(lao)動(dong)者(zhe)在(zai)本單位(wei)工(gong)(gong)(gong)作的(de)(de)(de)年(nian)(nian)限,每滿一年(nian)(nian)支付(fu)(fu)一個(ge)工(gong)(gong)(gong)資(zi)(zi)的(de)(de)(de)標準向勞(lao)(lao)(lao)動(dong)者(zhe)支付(fu)(fu)。六個(ge)月(yue)(yue)以(yi)上不滿一年(nian)(nian)的(de)(de)(de),按一年(nian)(nian)計(ji)算;不滿六個(ge)月(yue)(yue)的(de)(de)(de),向勞(lao)(lao)(lao)動(dong)者(zhe)支付(fu)(fu)半個(ge)月(yue)(yue)工(gong)(gong)(gong)資(zi)(zi)的(de)(de)(de)經濟(ji)(ji)補(bu)償(chang)勞(lao)(lao)(lao)動(dong)者(zhe)月(yue)(yue)工(gong)(gong)(gong)資(zi)(zi)高(gao)于用人單位(wei)所在(zai)直轄市(shi)、設區的(de)(de)(de)市(shi)級人民政(zheng)府公布的(de)(de)(de)本地區上年(nian)(nian)度職(zhi)工(gong)(gong)(gong)月(yue)(yue)平(ping)均(jun)工(gong)(gong)(gong)資(zi)(zi)三(san)倍的(de)(de)(de),向其支付(fu)(fu)經濟(ji)(ji)補(bu)償(chang)的(de)(de)(de)標準按職(zhi)工(gong)(gong)(gong)月(yue)(yue)平(ping)均(jun)工(gong)(gong)(gong)資(zi)(zi)三(san)倍的(de)(de)(de)數額(e)支付(fu)(fu),向其支付(fu)(fu)經濟(ji)(ji)補(bu)償(chang)的(de)(de)(de)年(nian)(nian)限最(zui)高(gao)不超過(guo)十(shi)二年(nian)(nian)本條(tiao)(tiao)所稱月(yue)(yue)工(gong)(gong)(gong)資(zi)(zi)是指勞(lao)(lao)(lao)動(dong)者(zhe)在(zai)勞(lao)(lao)(lao)動(dong)合(he)同解除或(huo)者(zhe)終止前十(shi)二個(ge)月(yue)(yue)的(de)(de)(de)平(ping)均(jun)工(gong)(gong)(gong)資(zi)(zi)。按規定(ding)向勞(lao)(lao)(lao)動(dong)者(zhe)支付(fu)(fu)經濟(ji)(ji)補(bu)償(chang)《實施條(tiao)(tiao)例》第二十(shi)三(san)條(tiao)(tiao):用人單位(wei)依法終止工(gong)(gong)(gong)傷職(zhi)工(gong)(gong)(gong)的(de)(de)(de)勞(lao)(lao)(lao)動(dong)合(he)同的(de)(de)(de),除依照《勞(lao)(lao)(lao)動(dong)合(he)同法》第四(si)十(shi)七(qi)(qi)條(tiao)(tiao)的(de)(de)(de)規定(ding)支付(fu)(fu)經濟(ji)(ji)補(bu)償(chang)外(wai),還應當依照國家有關工(gong)(gong)(gong)傷保險的(de)(de)(de)規定(ding)支付(fu)(fu)次性工(gong)(gong)(gong)傷醫療補(bu)助金和傷殘就(jiu)業補(bu)助金。
《實(shi)施條(tiao)例》第二十五條(tiao):用(yong)人單位(wei)違反勞(lao)動(dong)合同法的規定解除(chu)或者終止勞(lao)動(dong)合同,依照《勞(lao)動(dong)合同法》第八十七條(tiao)的規定支付(fu)了賠償金的,不再支付(fu)經濟補(bu)償。賠償金的計算(suan)年(nian)限(xian)自用(yong)工之日(ri)起計算(suan)。
備(bei)注(zhu):《勞動合(he)同(tong)(tong)法》第八十(shi)七條:用人單(dan)位違(wei)反本法規(gui)定解除(chu)或者終止勞動合(he)同(tong)(tong)的(de),應當依照本法第四十(shi)七條規(gui)定的(de)經濟補償標(biao)準的(de)二倍向勞動者支(zhi)付(fu)賠(pei)償金。
(二)重慶勞務特別需(xu)要(yao)提醒的(de)(de)是,解除或終止勞(lao)動(dong)(dong)(dong)合同(tong)的(de)(de)補償(chang)不僅僅是用人單(dan)位的(de)(de)責任,勞(lao)動(dong)(dong)(dong)者如違反了勞(lao)動(dong)(dong)(dong)合同(tong)也需(xu)要(yao)攴付(fu)違約金《實施條(tiao)例》第二十六條(tiao):用人單(dan)位與勞(lao)動(dong)(dong)(dong)者約定(ding)(ding)了服務期(qi),勞(lao)動(dong)(dong)(dong)者依照(zhao)《勞(lao)動(dong)(dong)(dong)合同(tong)法》第三十八條(tiao)的(de)(de)規定(ding)(ding)解除勞(lao)動(dong)(dong)(dong)合同(tong)的(de)(de),不屬于違反服務期(qi)的(de)(de)約定(ding)(ding),用人單(dan)位不得(de)要(yao)求勞(lao)動(dong)(dong)(dong)者支(zhi)付(fu)違約金。
