一(yi)、農民工與(yu)其他(ta)勞動者(zhe)一(yi)樣(yang),享有憲法和(he)法律規定的權(quan)利(li),按照《勞動法》相關規定,勞動者(zhe)享有以下(xia)基本權(quan)利(li):
1.勞動者(zhe)享有(you)平等就(jiu)業和選擇(ze)(ze)(ze)職(zhi)(zhi)業的(de)權利,即勞動者(zhe)在就(jiu)業時,不會(hui)因民族(zu)、種族(zu)、性(xing)別、宗(zong)教信仰不同而(er)受到用人單位(wei)的(de)歧視;選擇(ze)(ze)(ze)職(zhi)(zhi)業時,有(you)權選擇(ze)(ze)(ze)適(shi)合自(zi)己的(de)才能、愛好、興趣的(de)職(zhi)(zhi)業。
2.取得勞動(dong)報(bao)(bao)酬的權利(li),勞動(dong)者按用人(ren)單位的要求(qiu)付出了勞動(dong),就有權獲(huo)得相應的報(bao)(bao)酬。
3.休(xiu)(xiu)(xiu)(xiu)息(xi)(xi)休(xiu)(xiu)(xiu)(xiu)假的(de)(de)權(quan)利,休(xiu)(xiu)(xiu)(xiu)息(xi)(xi)休(xiu)(xiu)(xiu)(xiu)假是指勞(lao)(lao)動者在(zai)法律(lv)規定(ding)的(de)(de)時間(jian)(jian)(jian)里不必從事生(sheng)產和(he)工(gong)(gong)(gong)作(zuo)(zuo),自由支配自己時間(jian)(jian)(jian)的(de)(de)活動,即有權(quan)在(zai)規定(ding)的(de)(de)工(gong)(gong)(gong)作(zuo)(zuo)時間(jian)(jian)(jian)以(yi)外自行支配時間(jian)(jian)(jian)(《勞(lao)(lao)動法》規定(ding)職工(gong)(gong)(gong)每(mei)日(ri)工(gong)(gong)(gong)作(zuo)(zuo)不超過(guo)8小(xiao)時、每(mei)周工(gong)(gong)(gong)作(zuo)(zuo)不超過(guo)40小(xiao)時以(yi)外的(de)(de)時間(jian)(jian)(jian))。休(xiu)(xiu)(xiu)(xiu)息(xi)(xi)休(xiu)(xiu)(xiu)(xiu)假時間(jian)(jian)(jian)包括(kuo):工(gong)(gong)(gong)作(zuo)(zuo)日(ri)內的(de)(de)間(jian)(jian)(jian)歇(xie)時間(jian)(jian)(jian),即工(gong)(gong)(gong)作(zuo)(zuo)日(ri)內應給予職工(gong)(gong)(gong)休(xiu)(xiu)(xiu)(xiu)息(xi)(xi)和(he)用餐的(de)(de)間(jian)(jian)(jian)歇(xie)時間(jian)(jian)(jian)、每(mei)周公休(xiu)(xiu)(xiu)(xiu)假日(ri)(用人單位應當保證勞(lao)(lao)動者每(mei)周至少(shao)休(xiu)(xiu)(xiu)(xiu)息(xi)(xi)一(yi)天(tian))法定(ding)節假日(ri)、職工(gong)(gong)(gong)探親假、年(nian)休(xiu)(xiu)(xiu)(xiu)假。
4.獲得(de)勞動安全衛生保(bao)護的權利。
5.接受(shou)職業技能培訓(xun)的(de)權(quan)利。
6.提請(qing)勞動爭議處理(li)的權利(li)。
7.檢(jian)舉和(he)控(kong)告(gao)(gao)的權利(li),對違反勞動法律的行為(wei)有(you)向國家機關反映真實情況、對企業(ye)領導干部(bu)提出(chu)批評和(he)控(kong)告(gao)(gao)的權利(li)。
8.法(fa)(fa)(fa)律規(gui)定的(de)(de)其(qi)他勞動權利(li),包括依法(fa)(fa)(fa)組織參(can)加工會的(de)(de)權利(li),通過(guo)職(zhi)工大(da)會、職(zhi)工代表大(da)會或(huo)者(zhe)其(qi)他形式參(can)與(yu)民主管理,或(huo)者(zhe)就保護勞動者(zhe)合法(fa)(fa)(fa)權益(yi)與(yu)用人單位(wei)平等(deng)協商的(de)(de)權利(li),依法(fa)(fa)(fa)解除勞動合同的(de)(de)權利(li)等(deng)。
二、民(min)政部(bu)出臺《關(guan)于促(cu)進(jin)農(nong)民(min)工(gong)(gong)(gong)(gong)融入(ru)城(cheng)市(shi)(shi)(shi)(shi)社(she)區(qu)的(de)(de)(de)(de)(de)意(yi)見(jian)》當(dang)前(qian),我國(guo)外(wai)出農(nong)民(min)工(gong)(gong)(gong)(gong)有(you)1.64億(yi)人,其中約六(liu)成是(shi)(shi)新生(sheng)(sheng)代農(nong)民(min)工(gong)(gong)(gong)(gong),是(shi)(shi)城(cheng)市(shi)(shi)(shi)(shi)流動人口的(de)(de)(de)(de)(de)主要(yao)組成部(bu)分(fen)。雖然他們(men)中大(da)多數(shu)的(de)(de)(de)(de)(de)戶籍(ji)在農(nong)村,但他們(men)長(chang)期在城(cheng)市(shi)(shi)(shi)(shi)就(jiu)業(ye)、在社(she)區(qu)生(sheng)(sheng)活,既是(shi)(shi)社(she)區(qu)建(jian)設(she)的(de)(de)(de)(de)(de)參與者,也(ye)是(shi)(shi)社(she)區(qu)建(jian)設(she)的(de)(de)(de)(de)(de)受益(yi)者,有(you)融入(ru)城(cheng)市(shi)(shi)(shi)(shi)生(sheng)(sheng)活的(de)(de)(de)(de)(de)期盼,希望能夠像當(dang)地居民(min)一樣(yang)參與社(she)區(qu)管理,享(xiang)有(you)社(she)區(qu)服(fu)務,與城(cheng)市(shi)(shi)(shi)(shi)居民(min)平(ping)等享(xiang)有(you)城(cheng)市(shi)(shi)(shi)(shi)建(jian)設(she)和發展的(de)(de)(de)(de)(de)成果。對此,2012年(nian)1月(yue)4日民(min)政部(bu)出臺《關(guan)于促(cu)進(jin)農(nong)民(min)工(gong)(gong)(gong)(gong)融入(ru)城(cheng)市(shi)(shi)(shi)(shi)社(she)區(qu)的(de)(de)(de)(de)(de)意(yi)見(jian)》,首(shou)次(ci)從國(guo)家層(ceng)面描繪了(le)農(nong)民(min)工(gong)(gong)(gong)(gong)參與社(she)區(qu)生(sheng)(sheng)活的(de)(de)(de)(de)(de)“路線圖”,為(wei)維護農(nong)民(min)工(gong)(gong)(gong)(gong)合法權益(yi)提供了(le)制(zhi)度依據和保障(zhang)。這(zhe)是(shi)(shi)中央有(you)關(guan)部(bu)門就(jiu)農(nong)民(min)工(gong)(gong)(gong)(gong)融入(ru)社(she)區(qu)問題下發的(de)(de)(de)(de)(de)第一個專門性政策文件。意(yi)見(jian)主要(yao)從四(si)個方面進(jin)行了(le)闡述(shu):
1.充(chong)分(fen)認識促進(jin)農(nong)民工融入(ru)城市(shi)社區的重要意義。
2.正確把握(wo)促進農(nong)民工融入城市社區的指導思想和基本(ben)原則。
3.促進農民(min)工(gong)融(rong)入(ru)城市社區的主要任務。
4.加強對促進農民(min)工融入城(cheng)市社區工作的組織領導。
