其與勞(lao)動(dong)者(zhe)之(zhi)間存(cun)在勞(lao)動(dong)關系,繼而(er)主張(zhang)無(wu)義務(wu)向勞(lao)動(dong)者(zhe)支(zhi)付勞(lao)動(dong)報酬。第二,勞(lao)務(wu)作(zuo)(zuo)業(ye)承(cheng)包人(ren)(ren)(ren)將勞(lao)務(wu)作(zuo)(zuo)業(ye)再(zai)次(ci)分包給(gei)不(bu)具備(bei)用工資格的組(zu)(zu)織或自(zi)然(ran)(ran)人(ren)(ren)(ren),該等(deng)組(zu)(zu)織或自(zi)然(ran)(ran)人(ren)(ren)(ren)招用的勞(lao)動(dong)者(zhe)主張(zhang)其與勞(lao)務(wu)作(zuo)(zuo)業(ye)承(cheng)包人(ren)(ren)(ren)存(cun)在勞(lao)動(dong)關系,繼而(er)主張(zhang)勞(lao)務(wu)作(zuo)(zuo)業(ye)承(cheng)包人(ren)(ren)(ren)支(zhi)付勞(lao)動(dong)報酬;而(er)勞(lao)務(wu)作(zuo)(zuo)業(ye)承(cheng)包人(ren)(ren)(ren)否認(ren)其與勞(lao)動(dong)者(zhe)存(cun)在勞(lao)動(dong)關系,繼而(er)主張(zhang)無(wu)義務(wu)向勞(lao)動(dong)者(zhe)支(zhi)付勞(lao)動(dong)報酬。
可見,此類糾紛的(de)(de)(de)爭(zheng)議焦點是(shi)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)系(xi)(xi)(xi)(xi)的(de)(de)(de)存在(zai)(zai)與(yu)否(fou)。勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)系(xi)(xi)(xi)(xi),是(shi)指用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)招用(yong)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)為其成(cheng)(cheng)員(yuan),勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)在(zai)(zai)用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei)的(de)(de)(de)管(guan)理(li)下提供有報(bao)酬的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)而產生(sheng)的(de)(de)(de)權利義務關(guan)系(xi)(xi)(xi)(xi)。勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)法律關(guan)系(xi)(xi)(xi)(xi)的(de)(de)(de)一(yi)方(勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe))必(bi)須(xu)加(jia)人(ren)某一(yi)個用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei),成(cheng)(cheng)為該(gai)單(dan)(dan)位(wei)(wei)(wei)(wei)的(de)(de)(de)一(yi)員(yuan),并(bing)(bing)參加(jia)單(dan)(dan)位(wei)(wei)(wei)(wei)的(de)(de)(de)生(sheng)產勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong),遵守單(dan)(dan)位(wei)(wei)(wei)(wei)內部的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)規則。而另一(yi)方(用(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)(wei))則必(bi)須(xu)按照勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)數最(zui)或質址給付其報(bao)酬,提供工作(zuo)條(tiao)件,并(bing)(bing)不斷提高勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)的(de)(de)(de)物質文化生(sheng)活(huo).通說認為勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)系(xi)(xi)(xi)(xi)有以下三個法律特征:第一(yi),勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)系(xi)(xi)(xi)(xi)是(shi)在(zai)(zai)現實勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)過程(cheng)中(zhong)所發生(sheng)的(de)(de)(de)關(guan)系(xi)(xi)(xi)(xi),與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)有著(zhu)直(zhi)接的(de)(de)(de)聯系(xi)(xi)(xi)(xi)。第二,勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)系(xi)(xi)(xi)(xi)的(de)(de)(de)雙方當事人(ren),一(yi)方是(shi)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe),另一(yi)方是(shi)提供生(sheng)產資料(liao)的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)所在(zai)(zai)單(dan)(dan)位(wei)(wei)(wei)(wei)。第三,勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)系(xi)(xi)(xi)(xi)的(de)(de)(de)一(yi)方勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者(zhe),要成(cheng)(cheng)為另一(yi)方所在(zai)(zai)單(dan)(dan)位(wei)(wei)(wei)(wei)的(de)(de)(de)成(cheng)(cheng)員(yuan),要遵守單(dan)(dan)位(wei)(wei)(wei)(wei)內部的(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)規則以及有關(guan)制度。
《勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)和(he)社會(hui)保障部(bu)(bu)關于確立勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關系有關事項的(de)(de)通知》(2005年5月(yue)25日勞(lao)(lao)(lao)(lao)社部(bu)(bu)發(fa)[2005] 12號)第(di)一(yi)條(tiao)規(gui)定(ding):用(yong)(yong)人單(dan)(dan)位(wei)招用(yong)(yong)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)未訂立書面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同,但同時具備下列情形的(de)(de),勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關系成(cheng)立。(一(yi))用(yong)(yong)人單(dan)(dan)位(wei)和(he)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)符合法(fa)律、法(fa)規(gui)規(gui)定(ding)的(de)(de)主(zhu)體資格;(二)用(yong)(yong)人單(dan)(dan)位(wei)依法(fa)制(zhi)定(ding)的(de)(de)各項勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)規(gui)章制(zhi)度適用(yong)(yong)于勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe).勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)受(shou)用(yong)(yong)人單(dan)(dan)位(wei)的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)管理,從(cong)事用(yong)(yong)人單(dan)(dan)位(wei)安(an)排的(de)(de)有報酬(chou)的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong);(三)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)提(ti)供的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)是(shi)用(yong)(yong)人單(dan)(dan)位(wei)業務(wu)的(de)(de)組(zu)(zu)成(cheng)部(bu)(bu)分。據此,爭(zheng)議解決機構(勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)仲裁委員會(hui)和(he)人民法(fa)院)在(zai)認定(ding)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關系是(shi)否(fou)存(cun)在(zai)時一(yi)般會(hui)著重考察如下幾個問題:第(di)一(yi)用(yong)(yong)人單(dan)(dan)位(wei)是(shi)否(fou)其備用(yong)(yong)工(gong)資格;第(di)二,勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)是(shi)否(fou)被用(yong)(yong)人單(dan)(dan)位(wei)的(de)(de)規(gui)章制(zhi)度所約束和(he)管理;第(di)三,勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)所提(ti)供勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)是(shi)否(fou)是(shi)用(yong)(yong)人單(dan)(dan)位(wei)的(de)(de)業務(wu)的(de)(de)組(zu)(zu)成(cheng)部(bu)(bu)分,用(yong)(yong)人單(dan)(dan)位(wei)是(shi)否(fou)為勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)提(ti)供生產資料和(he)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)條(tiao)件。
在(zai)(zai)此基(ji)礎上(shang),國(guo)家對(dui)建筑施工(gong)(gong)(gong)、礦(kuang)山(shan)企(qi)(qi)業(ye)(ye)(ye)的(de)勞(lao)(lao)(lao)(lao)動(dong)關(guan)系認定(ding)作出了特別(bie)約定(ding)。《勞(lao)(lao)(lao)(lao)動(dong)和社會保障(zhang)部關(guan)于確立(li)勞(lao)(lao)(lao)(lao)動(dong)關(guan)系有關(guan)事(shi)項的(de)通知》第四(si)條規定(ding):“建筑施工(gong)(gong)(gong)、礦(kuang)山(shan)企(qi)(qi)業(ye)(ye)(ye)等用(yong)人(ren)(ren)(ren)(ren)單位將(jiang)工(gong)(gong)(gong)程(業(ye)(ye)(ye)務(wu))或經(jing)營權發包給(gei)不具備用(yong)工(gong)(gong)(gong)主(zhu)(zhu)體(ti)資(zi)格的(de)組(zu)織或自然人(ren)(ren)(ren)(ren).對(dui)該組(zu)織或自然人(ren)(ren)(ren)(ren)招用(yong)的(de)勞(lao)(lao)(lao)(lao)動(dong)者(zhe)(zhe).由具備用(yong)工(gong)(gong)(gong)主(zhu)(zhu)體(ti)資(zi)格的(de)發包方承(cheng)擔用(yong)工(gong)(gong)(gong)主(zhu)(zhu)體(ti)責任。”根據該條規定(ding),在(zai)(zai)勞(lao)(lao)(lao)(lao)動(dong)者(zhe)(zhe)與勞(lao)(lao)(lao)(lao)務(wu)作業(ye)(ye)(ye)發包人(ren)(ren)(ren)(ren)或勞(lao)(lao)(lao)(lao)務(wu)作業(ye)(ye)(ye)承(cheng)包人(ren)(ren)(ren)(ren)不存在(zai)(zai)勞(lao)(lao)(lao)(lao)動(dong)關(guan)系的(de)情況下,只要勞(lao)(lao)(lao)(lao)動(dong)者(zhe)(zhe)是(shi)不具備用(yong)工(gong)(gong)(gong)主(zhu)(zhu)體(ti)資(zi)格的(de)勞(lao)(lao)(lao)(lao)務(wu)作業(ye)(ye)(ye)承(cheng)包人(ren)(ren)(ren)(ren)招用(yong)的(de).勞(lao)(lao)(lao)(lao)務(wu)作業(ye)(ye)(ye)發包人(ren)(ren)(ren)(ren)或勞(lao)(lao)(lao)(lao)務(wu)作業(ye)(ye)(ye)承(cheng)包人(ren)(ren)(ren)(ren)即應承(cheng)擔用(yong)工(gong)(gong)(gong)主(zhu)(zhu)體(ti)貴任。也(ye)就是(shi)說,勞(lao)(lao)(lao)(lao)務(wu)作業(ye)(ye)(ye)發包人(ren)(ren)(ren)(ren)或勞(lao)(lao)(lao)(lao)務(wu)作業(ye)(ye)(ye)承(cheng)包人(ren)(ren)(ren)(ren)在(zai)(zai)此等情況下應向勞(lao)(lao)(lao)(lao)動(dong)者(zhe)(zhe)支付(fu)勞(lao)(lao)(lao)(lao)動(dong)報(bao)酬。
