  勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)遣(qian),是(shi)指(zhi)由派(pai)(pai)(pai)遣(qian)機(ji)構與(yu)派(pai)(pai)(pai)遣(qian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)訂立勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong),勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)關(guan)系存在(zai)于派(pai)(pai)(pai)遣(qian)機(ji)構與(yu)派(pai)(pai)(pai)遣(qian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)之間,但勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)力給付的(de)(de)(de)事實則發生于派(pai)(pai)(pai)遣(qian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)與(yu)要派(pai)(pai)(pai)企業(ye)之間。勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)派(pai)(pai)(pai)遣(qian)的(de)(de)(de)最顯著(zhu)特(te)征就是(shi)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)力的(de)(de)(de)雇用和(he)使用分離。簡(jian)單(dan)(dan)地講(jiang),勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)與(yu)其工作的(de)(de)(de)單(dan)(dan)位(wei)(wei)不是(shi)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)系,而是(shi)與(yu)另一人(ren)(ren)才(cai)中(zhong)介等(deng)專(zhuan)門單(dan)(dan)位(wei)(wei)形(xing)成勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)系,再由該從(cong)才(cai)機(ji)構派(pai)(pai)(pai)到用人(ren)(ren)單(dan)(dan)位(wei)(wei)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong),用人(ren)(ren)單(dan)(dan)位(wei)(wei)與(yu)人(ren)(ren)才(cai)機(ji)構簽訂派(pai)(pai)(pai)遣(qian)協議。與(yu)其他(ta)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)經(jing)濟(ji)形(xing)式(shi)相比(bi)較,勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)遺有兩個最大的(de)(de)(de)特(te)點,一是(shi)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)是(shi)派(pai)(pai)(pai)遣(qian)公(gong)司的(de)(de)(de)職(zhi)工,存在(zai)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)關(guan)系。這(zhe)與(yu)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)中(zhong)介、勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)代理不同(tong);二是(shi)派(pai)(pai)(pai)遣(qian)公(gong)司只從(cong)事勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)遣(qian)業(ye)務(wu)(wu)(wu),不承(cheng)包項目,這(zhe)與(yu)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)承(cheng)包不同(tong)。由于其行(xing)業(ye)的(de)(de)(de)特(te)殊性,目前在(zai)建筑行(xing)業(ye)很多用人(ren)(ren)單(dan)(dan)位(wei)(wei)對作業(ye)層人(ren)(ren)員也采取了(le)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)遣(qian)的(de)(de)(de)形(xing)式(shi)。

  勞(lao)(lao)務(wu)派(pai)遣是我(wo)國(guo)在建立勞(lao)(lao)動力市場(chang)機制的(de)實(shi)踐過程中(zhong)提出(chu)(chu)的(de)一(yi)個現(xian)實(shi)課題(ti)(ti),是我(wo)國(guo)勞(lao)(lao)務(wu)經濟(ji)中(zhong)比較新的(de)一(yi)種形式(shi),也(ye)是目(mu)前(qian)發展(zhan)很(hen)(hen)快、問(wen)題(ti)(ti)很(hen)(hen)多的(de)一(yi)種形式(shi)。在其發展(zhan)的(de)過程中(zhong)出(chu)(chu)現(xian)了不少濫用勞(lao)(lao)務(wu)派(pai)遣用工形式(shi),侵(qin)害(hai)勞(lao)(lao)動者合(he)法權益的(de)問(wen)題(ti)(ti)。針對(dui)此,《實(shi)施條例》對(dui)勞(lao)(lao)務(wu)派(pai)遣作(zuo)了三個方(fang)面的(de)具(ju)體規定:

  這三個(ge)方面(mian)的(de)具體規定包括:

  1.為了避(bi)免(mian)用工(gong)(gong)(gong)單位(wei)(wei)規(gui)(gui)避(bi)勞動合同法律義務(wu),侵害勞動者的合法權益,《實施(shi)條例(li)》規(gui)(gui)定用工(gong)(gong)(gong)單位(wei)(wei)應(ying)當履(lv)行(xing)(xing)《勞動合同法》第六十(shi)二條規(gui)(gui)定的義務(wu)。:這些義務(wu)包括支付加(jia)班費、績(ji)效獎金,提(ti)供與工(gong)(gong)(gong)作崗位(wei)(wei)相關的福利待(dai)遇連續(xu)用工(gong)(gong)(gong)的要實行(xing)(xing)正常的工(gong)(gong)(gong)資調整機制等。如(ru)果(guo)用工(gong)(gong)(gong)單位(wei)(wei)不履(lv)行(xing)(xing)這些義務(wu),依(yi)照《實施(shi)條例(li)》規(gui)(gui)定用工(gong)(gong)(gong)單位(wei)(wei)就必須承擔相應(ying)的法律責(ze)任。

  2.為了避(bi)免勞(lao)務派(pai)(pai)遣單位以(yi)非全日(ri)(ri)制(zhi)(zhi)用(yong)王(wang)形式(shi)招(zhao)用(yong)勞(lao)動者(zhe)(zhe),侵害勞(lao)動者(zhe)(zhe)的合法權(quan)益,《實(shi)施條例》規定勞(lao)務派(pai)(pai)遣單位不(bu)得(de)以(yi)非全日(ri)(ri)制(zhi)(zhi)用(yong)工形式(shi)招(zhao)用(yong)被派(pai)(pai)遣勞(lao)動者(zhe)(zhe)。

  3.為了維護勞(lao)(lao)(lao)務(wu)派遣(qian)(qian)玊的(de)合法權益冫(bing)避(bi)免用(yong)(yong)人(ren)單位(wei)(wei)(wei)(wei)濫用(yong)(yong)勞(lao)(lao)(lao)務(wu)派遣(qian)(qian)用(yong)(yong)工形式,依(yi)照《勞(lao)(lao)(lao)動合同(tong)(tong)法》第四十六條(tiao)第七項(xiang)“法律、行政法規(gui)(gui)(gui)規(gui)(gui)(gui)定的(de)其他(ta)情(qing)形”的(de)規(gui)(gui)(gui)定以及(ji)《實施條(tiao)例》規(gui)(gui)(gui)定:勞(lao)(lao)(lao)務(wu)派遣(qian)(qian)單位(wei)(wei)(wei)(wei)或者(zhe)被派遣(qian)(qian)勞(lao)(lao)(lao)動者(zhe)依(yi)法解除或者(zhe)終止(zhi)勞(lao)(lao)(lao)動合同(tong)(tong)的(de),勞(lao)(lao)(lao)務(wu)派遣(qian)(qian)單位(wei)(wei)(wei)(wei)也應當向該勞(lao)(lao)(lao)動者(zhe)支付經(jing)濟補(bu)償。用(yong)(yong)人(ren)單位(wei)(wei)(wei)(wei)應及(ji)時了解國家的(de)相關(guan)政策(ce)法規(gui)(gui)(gui),熟悉勞(lao)(lao)(lao)務(wu)派遣(qian)(qian)業務(wu)正規(gui)(gui)(gui)運作流(liu)程。

  目前(qian)勞務派(pai)遣業務的基本流程主要包括以(yi)下幾個方面(mian):

  1.勞(lao)(lao)務派(pai)遣組(zu)(zu)織派(pai)遣手(shou)續流程:用(yong)人(ren)單位(wei)向有資質的(de)勞(lao)(lao)務派(pai)造(zao)組(zu)(zu)織提(ti)出用(yong)工需求,確定用(yong)人(ren)名單,在雙方遵守國家《勞(lao)(lao)動(dong)法》的(de)前提(ti)下,協商并簽訂《勞(lao)(lao)務派(pai)遣協議(yi)》;勞(lao)(lao)務派(pai)遣組(zu)(zu)織與(yu)勞(lao)(lao)動(dong)者簽訂《勞(lao)(lao)動(dong)合同》:用(yong)人(ren)單位(wei)與(yu)勞(lao)(lao)動(dong)者只簽訂《工作崗位(wei)協議(yi)》。

  2.勞務派(pai)遣(qian)組(zu)織社會保(bao)險繳納流(liu)程:按照勞務派(pai)遣(qian)組(zu)織與用大單位協議(yi),每月在規(gui)定時間內由用人(ren)(ren)(ren)單位向勞務派(pai)遣(qian)單位上報本月增減人(ren)(ren)(ren)員(yuan)(yuan),支付當月社保(bao)費用,并由勞務派(pai)遣(qian)單位為派(pai)遣(qian)人(ren)(ren)(ren)員(yuan)(yuan)代交社保(bao)費;符合“五險一(yi)金”享受待遇的派(pai)遣(qian)人(ren)(ren)(ren)員(yuan)(yuan),由勞務派(pai)遣(qian)組(zu)織辦理相關(guan)手(shou)續.

  3.勞務(wu)(wu)(wu)派(pai)遣組織(zhi)工資發(fa)放流程:按(an)照(zhao)勞務(wu)(wu)(wu)派(pai)遣組織(zhi)嶼用人單位(wei)(wei)協議(yi),每月在(zai)規定時間(jian)內由(you)用人單位(wei)(wei)向勞務(wu)(wu)(wu)派(pai)遣單位(wei)(wei)提供勞務(wu)(wu)(wu)人員工資考核情況,確定派(pai)遺人員應發(fa)工資總額(e)、福利待遇、個稅、社保(bao)費(fei)加班費(fei)等,支付費(fei)用總額(e),并由(you)勞務(wu)(wu)(wu)派(pai)遣代(dai)交社保(bao)費(fei),代(dai)交個人所得(de)稅。

  4.勞(lao)務(wu)派(pai)遣(qian)組織辦理檔(dang)(dang)案(an)(an)存放流程:由勞(lao)務(wu)派(pai)遣(qian)單位所在職(zhi)介中心的存檔(dang)(dang)機構(gou)開具“商調(diao)(diao)(diao)函(han)”;并領取集(ji)體存檔(dang)(dang)登記表;持“商調(diao)(diao)(diao)函(han)”及集(ji)體存檔(dang)(dang)表回(hui)原單位辦理調(diao)(diao)(diao)出手續;對于新參(can)加(jia)工作的大中專畢業(ye)生需簽(qian)署三(san)方協議,后將(jiang)(jiang)檔(dang)(dang)案(an)(an)調(diao)(diao)(diao)入;對于檔(dang)(dang)案(an)(an)在街道再(zai)次就業(ye)人(ren)員,需辦理招工手續,后將(jiang)(jiang)檔(dang)(dang)案(an)(an)調(diao)(diao)(diao)入。
