建筑勞務(wu)分包(bao)的面積如(ru)何計算(suan)?
1、做(zuo)到合法(fa)分包,規范操作;
第一、項目(mu)部負責(ze)人在授(shou)權對外簽訂勞務分包合同時,應嚴格(ge)審查分包企業的資質;
第二(er)、必須簽訂勞務(wu)分包(bao)合(he)同,并在(zai)簽訂分包(bao)合(he)同時,要(yao)有完備的合(he)同條款(kuan);三是建立(li)勞務(wu)分包(bao)合(he)格人員名單,定期(qi)對分包(bao)單位進(jin)行考核,并加(jia)強對分包(bao)單位的監督管(guan)理。
2、依法規范勞(lao)務分包用工行為。
為防止勞動(dong)(dong)合同(tong)糾紛的發(fa)生,勞務(wu)(wu)分包(bao)企業招(zhao)用農(nong)民工(gong)必須規范操作,要按規定(ding)先報(bao)批后使(shi)用,嚴禁擅自招(zhao)用農(nong)民工(gong)。未來對農(nong)民工(gong)的使(shi)用主要有兩種方式:一是由勞務(wu)(wu)公司派遣(qian),農(nong)名工(gong)與派遣(qian)單(dan)(dan)位簽訂(ding)固(gu)定(ding)期限(xian)勞動(dong)(dong)合同(tong),用工(gong)單(dan)(dan)位根(gen)據工(gong)作崗(gang)位的實際(ji)需要,與派遣(qian)單(dan)(dan)位確定(ding)派遣(qian)期限(xian);二(er)是直接與農(nong)民工(gong)簽訂(ding)勞動(dong)(dong)合同(tong)。
3、禁止使用自然人(包(bao)工頭)和沒有資格的雇傭兵(bing)。
私拉濫(lan)招、非法(fa)用工(gong)(gong)(gong)、違(wei)法(fa)勞(lao)(lao)(lao)務分包、拖欠農民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)等“包工(gong)(gong)(gong)頭(tou)”行為是引發勞(lao)(lao)(lao)務糾(jiu)紛(fen)的(de)根源。所以,禁止使(shi)用“包工(gong)(gong)(gong)頭(tou)”和(he)沒(mei)有資(zi)質(zhi)的(de)勞(lao)(lao)(lao)務隊伍是消除分包糾(jiu)紛(fen)的(de)根本所在,也是大勢所趨。國家住房和(he)城鄉建設部(bu)早就在文件中提出,要建立基(ji)本規范(fan)的(de)建筑(zhu)勞(lao)(lao)(lao)務分包制(zhi)度,逐步取(qu)消建筑(zhu)勞(lao)(lao)(lao)務領域中的(de)“包工(gong)(gong)(gong)頭(tou)”,清理(li)無(wu)資(zi)質(zhi)用工(gong)(gong)(gong)。與此同(tong)時,鼓勵一些施工(gong)(gong)(gong)能力強、信譽好的(de)勞(lao)(lao)(lao)務企業到工(gong)(gong)(gong)商注冊(ce),取(qu)得資(zi)質(zhi)證書,并(bing)與之建立長期合(he)作關系。
